Dear Hambleton District Council,

Under the Freedom of Information Act 2000, you are requested to please provide the following:

1 Copies of all commercial Hambleton’s public liability insurance policy certificates with what
is covered, policy numbers, providers and underwriters held by Hambleton In particular,
make sure anything regarding ‘pollution liability’, ‘policy enhancement’ and ‘schedules of
exclusions’ documents in relation to the commercial public liability insurance policy held by
Hambleton.

2 Copies of the ‘certificate of indemnity’ from Hambleton that may include the public
insurance provider and underwriters, confirming that any injuries, damages or adverse
health effects directly or indirectly arising out of, resulting from or contributed to by
electromagnetic fields, electromagnetic radiation, electromagnetism, radio waves or noise,
wireless RF radiation, microwave radiation, non-ionising radiation emitting devices and
equipment.

3 I require written receipt of this Freedom of Information Request.

You have failed to respond to the request which related to the negative effects of electromagnetic fields specifically 5G masts and the request for details of the insurance covering any claim made for health issues relating to the 5G masts and other electromagnetic fields.

I can only conclude the the council is prepared to erect structures which have been challenged as being damaging to health yet the welfare of its ratepayers and residents is of no consequence.

Perhaps instead of sending lengthy documents which are not related to the topic in question, you could provide an honest reply.

Thank you for your email requesting an internal review of Hambleton
District Council’s response to your Freedom of Information Request. I have
now conducted the review and I am in a position to share my findings with
you.

 

You raised a FOI request on the 29th August 2020 that was answered by
Hambleton District Council on the 19th October 2020.

 

On the 24th October 2020 you made a complaint regarding the response
stating, "You have failed to respond to the request which related to the
negative effects of electromagnetic fields specifically 5G masts and the
request for details of the insurance covering any claim made for health
issues relating to the 5G masts and other electromagnetic fields". I will
address this part of your complaint in the internal review, as this is a
complaint alleging that all parts of your request have not been addressed.

 

You also stated, "I can only conclude the council is prepared to erect
structures which have been challenged as being damaging to health yet the
welfare of its ratepayers and residents is of no consequence. Perhaps
instead of sending lengthy documents which are not related to the topic in
question, you could provide an honest reply". These are statements of
opinion and will not be addressed in this internal review as they are not
a complaint about the processing of the FOI request.

 

 You had asked for the following information in your request:

 

1    Copies of all commercial Hambleton’s public liability insurance
policy certificates with what is covered, policy numbers, providers and
underwriters held by Hambleton In particular, make sure anything regarding
‘pollution liability’, ‘policy enhancement’ and ‘schedules of exclusions’
documents in relation to the commercial public liability insurance policy
held by Hambleton.

 

These documents have been provided in the response and state the policy
reference and provider, and also state what is covered by the public
liability insurance.

  

2    Copies of the ‘certificate of indemnity’ from Hambleton that may
include the public insurance provider and underwriters, confirming that
any injuries, damages or adverse health effects directly or indirectly
arising out of, resulting from or contributed to by electromagnetic
fields, electromagnetic radiation, electromagnetism, radio waves or noise,
wireless RF radiation, microwave radiation, non-ionising radiation
emitting devices and equipment.

 

The certificate of indemnity has been provided in the response.

 

Hambleton does not hold any documents which specifically cover; 'any
injuries, damages or adverse health effects directly or indirectly arising
out of, resulting from or contributed to by electromagnetic fields,
electromagnetic radiation, electromagnetism, radio waves or noise,
wireless RF radiation, microwave radiation, non-ionising radiation
emitting devices and equipment.'

 

Review results:

Having reviewed the District Council's response to your request I uphold
the Council's response as all information that Hambleton District Council
holds that falls within the scope of your request has been disclosed to
you. 

 

If you remain dissatisfied with my response you may complain to the
Information Commissioner’s Office. I have attached our appeals process
which informs you as to how you can do this.
