This request follows my observation of part of a East of England Ambulance Service NHS Trust "public board meeting" on the afternoon of 9 September 2020.

During the meeting the existence of a private board meeting prior to the public meeting was revealed. This request seeks the agenda for that private meeting.

During the meeting reference was made to the "accountability committee" as the meeting where the slowest response times were reviewed. The public board meeting papers indicate there are a set of regional accountability committees.

response below.  Your request has been allocated the following reference:
28880, please could you quote this reference in any future correspondence

I would like to request the release of:

 

* The agenda for the  England Ambulance Service NHS Trust board meeting
held on the morning of 9 September 2020.

 

* The agenda and papers for the latest accountability committee meeting
for the region covering Cambridge.

 

Please find the relevant documents attached.

 

East of England Ambulance Service Trust has determined that the
information some of the information in the documents attached is personal
data and as such we will be applying exemption s.40(2) and s.40(3A)(a) of
the Freedom of Information Act to your request.  This information has been
redacted from the documents attached.

 

Section 40 (2)

Any information to which a request for information relates is also exempt
information if-
(a) it constitutes personal data which does not fall within subsection
(1), and
(b) either the first, second or third condition below is satisfied

 

The first condition includes if disclosure of the information to a member
of the public otherwise than under FOIA would contravene any of the data
protection principles (s.40(3A)(a)).

 

In this case the Trust believes that disclosure of the information would
result in a breach of the first principle stated in the Data Protection
Act 2018.

 

First Data Protection Principle:
(1) The first data protection principle is that the processing of personal
data for any of the law enforcement purposes must be lawful and fair.
(2) The processing of personal data for any of the law enforcement
purposes is lawful only if and to the extent that it is based on law and
either-
                (a) the data subject has given consent to the processing
for that purpose, or
                (b) the processing is necessary for the performance of a
task carried out for that purpose by a competent authority

 

The Trust considers that disclosure of this information would not be fair
and therefore the information is exempt from disclosure.

 

Section 40(2) together with s.40(3A)(a) provide an absolute exemption and
therefore is not subject to the public interest test.

 

 

I am obliged to advise you that if you are dissatisfied with the Trust’s
response to your request you have a right to complain to the Trust and
should set out your concerns to the Freedom of Information Officer, EEAST,
Hospital Approach, Broomfield, Chelmsford, Essex, CM1 7WS or by email to
