Public Sector Equality Duty and Traffic and Transport Planning

Dear Haringey Borough Council,

The information I am requesting is in the last paragraph but I set out the background so as to ensure my request is clear.

I refer to Councillor Kirsten Hearn's statement in writing on 23rd December 2018 that Haringey Council has a policy of not collecting equalities monitoring information "We deliberately avoid including ... equalities monitoring ... consultation we do" in Traffic and Transport Planning. Kirsten Hearn is Haringey Council's Cabinet Member for Environment.

In common with all public bodies in England, Haringey Council has a Public Sector Equality Duty under the Equality Act 2010 to ensure that in the exercise of its functions Haringey Council must have due regard of the need to "Advance equality of opportunity between people who share a protected characteristic and those who do not". My original enquiry had raised concerns about Haringey Council's policies impacting on Disabled people and Polish people and others from from newly arrived communities, who are under-represented in views collected. Also taking the 2018 Haringey residents survey as an example, Disabled people with a disability that impacts significantly, are much more likely to feel unsafe at night than the general population; and other white respondents, which includes newly arrived Polish and Romanian communities, are much more likely to disagree with the statement that people of different backgrounds get on well. Interestingly the residents survey includes an whole analysis on parking but fails to include any questions on transport or accessibility, despite the fact that many of Haringey's pavements and walkways are impassable for wheelchair users.

Given Haringey Council's Public Sector Equality Duty, please provide any information to indicate whether the Traffic and Transport Planning needs of Disabled people and newly arrived communities, including Polish people and Romanian people are the same or different to that of the Haringey population as a whole.

Thank you for your request for information received on 05 January 2019, in
which you asked for any information to indicate whether the Traffic and
Transport Planning needs of Disabled people and newly arrived communities,
including Polish people and Romanian people are the same or different to
that of the Haringey population as a whole.

 

Haringey has “general public body duties” under equalities legislation and
statutory duties to promote equality arising from the Equality Act 2010.

 

The purpose of undertaking an EqIA is to help ensure the strategy does not
discriminate against any individual or community and to promote equality
for all, where possible, including the groups you mention. The EqIA
identifies the potential impacts and any disproportionate effects on
Target Equalities Groups because of the implemented strategy and reports
committed mitigation measures to reduce negative impacts and increase
benefits to maximise positive equality outcomes.

 

Under the 2010 Act, the council’s duties apply to groups with protected
characteristics as the grounds upon which discrimination is unlawful. The
protected characteristics are age; disability; gender; gender
reassignment; marriage and civil partnership; pregnancy and maternity;
race/ethnicity/ nationality; religion/belief; and sexual orientation. The
groups you request information for are considered to be covered by
one/more of the protected characteristics above.

 

All traffic and transport Planning decisions are made in accordance with
the Council’s policies including, and more specifically for your request,
the adopted Transport Strategy. The Transport Strategy was subject to an
Equalities Impact Assessment  (EqIA) and can be found here:

I am writing to request an internal review of Haringey Borough Council's handling of my FOI request 'Public Sector Equality Duty and Traffic and Transport Planning'.

I requested the following information:

The response I received Neil Goldberg states that Haringey Council complies with its Equality Act duties. I am not clear whether this is a reason for refusing to provide the information, however the information I requested has not been provided.
