I would like to request the released of all information held in relation to a dedicated CCTV pole in the Fen Road / Water Street / Water Lane area of Cambridge.

I expect the council will hold a grant application, financial transaction records, and perhaps a specification for the pole, location plans and consultation materials, public and councillor comments, as well as related records of decisions and correspondence with contractors and the county council.

I would like to exclude records of formal council meetings from the scope of my request.

I am only seeking information from the current year.

In September 2018 Cambridge's North Area Committee was told the council have given a grant to a community group to pay for a dedicated column to hold a council CCTV camera on Cambridge’s Fen Road.

Thank you for your request for information above, which we have dealt with
under the terms of the Freedom of Information Act 2000.

 

Attached is the information held by the council in relation to your
request.

 

Some information has been withheld because an exemption applies.

 

Personal identifiable information relating to third parties including
members of the public engaging with the council over this matter,
signatures and direct staff contacts for some junior members of staff has
been withheld under s40(2) of the Act.

 

Section 40 sets out that personal data can only be released where doing so
does not breach any of the data protection principles.

 

The General Data Protection Regulation (which has enacted in UK law by the
Data Protection Act 2018) states: “Personal data shall be: (a) processed
lawfully, fairly and in a transparent manner in relation to the data
subject (‘lawfulness, fairness and transparency’).”

 

Release of information relating to members of the public engaging with the
council in relation to this project, as well as the personal information
of contractors would not be fair.

 

Release of the signature and contact details of junior members of staff
who are not public facing, do not have significant responsibility for
budgets or policies would not be fair. We are therefore not releasing this
information.

 

This is an absolute exemption and there is no need to consider the public
interest.

 

We have also withheld information relating to the operational arrangements
of the redeployable CCTV camera. We are not obliged to provide information
if its release would prejudice law enforcement. In this case, we believe
that releasing the information would be likely to prejudice the prevention
or detection of crime (section 31(1) (a) of the Act).

 

Public Interest Test

Whilst it is in the public interest to release information held by public
bodies, to aid understanding, transparency, awareness and accountability,
it is also in the public interest that information that would be of
particular use for criminal activity is not readily disseminated and the
information requested falls into this category.

 

On balance, the public interest is against disclosure.
