Section 22 Wrongly Applied

Dear Department of Health and Social Care,

I write further to your response to FOI-1131240.

In that response DHSC applied a Section 22 exemption to a large number of then pending Freedom of Information requests, the basis for this was that, at the time of your response, an "assurance process" had been instigated.

However, Section 22 of the FOIA specifically states that:

"The intention to publish must pre-date the request. This means that a public authority cannot, when it receives a request, attempt to give itself more time to provide the information by deciding to publish it in the future rather than provide it within the statutory time limit for answering a request. "

Given that many of the requests which were refused on the grounds of the Section 22 exemption date back to early May 2018, I believe it is the case that many of these requests pre-date the intention to publish and therefore the Section 22 exemption cannot be applied.

This is a new Freedom of Information Request and I would like to request the following information:

a) How many of the requests listed in the annex of FOI-1131240 pre-date the intention to publish (the date on which DHSC asked GIAA to conduct an "assurance process") and which requests they are.

b) The date on which DHSC asked GIAA to conduct an "assurance process".
