Dear Dudley Council

What is the hourly rate and standard rate that you paid to independent providers for the years 2016/2017 and 2017/2018?

How many providers do you commission domiciliary care from?

How do you check that domiciliary providers do not breach minimum wage and pay their care workers for their travel time and do not cram calls with no travel time, meaning some care staff are forced to cut calls?

What hourly rate do you pay providers for sleep-ins and does this cover minimum wage for all hours the sleep-in care workers spends with the service user?

So Dudley Council only expects the care providers they commission care from adhere to minimum wage law and you do not actually do any robust checks and don't take any enforcement action if a provider ignores minimum wage law by not paying domiciliary care workers travel time which is required to be paid as working time as per NMW Law?

Our response
 
As per the contract :
 
The price to be paid for the Service shall include the cost of all
processes required to ensure that the Service complies with the terms of
this Contract. The Service Provider must ensure that the hourly price
fully covers the following:
 

* Staff wages and salaries and all associated employment costs which are
to be set at a realistic level in order to attract and retain suitable
personnel of a calibre to meet the service requirements, this will
include travel time and costs, payment for attending training and
statutory sick pay for eligible workers.

 

* The Provider must issue care workers with a weekly service user rota
which details times and amounts of care to be delivered, and allows
sufficient travel time between calls.

 
As part of the contract management and quality monitoring where concerns
or complaints arise the evidence of the above may be scrutinised.
