Access to public right of way via Carvell Close, off Browns Lane
Dear Coventry City Council,
Ordnance survey mapping shows a public right of way to be accessed at OS Grid Ref: SP29858 82191. Per the map, I should be able to access the public right of way via Carvell Close, off Browns Lane. However, this is not possible due to home owners having fences blocking access.
Could you tell me whether this path has been blocked lawfully and if it has, under what section of law. If the path is blocked deliberately, is it a criminal offence under Section 137 of the Highways Act 1980. Either way could you tell me how I may lawfully access this public right of way?

I am writing to request an internal review of Coventry City Council's handling of my FOI request 'Access to public right of way via Carvell Close, off Browns Lane'.
My request was a follows:
'Ordnance survey mapping shows a public right of way to be accessed at OS Grid Ref: SP29858 82191. Per the map, I should be able to access the public right of way via Carvell Close, off Browns Lane. However, this is not possible due to home owners having fences blocking access.

Your response was as follows:
'We advise that there is no public right of way recorded from the parish boundary to
Brown’s Lane via Carvell Close.'
I would like further clarification on this matter. OS maps clearly marks a public right of way and whilst I am aware that this does not necessarily mean there is a right of way, I am wondering how this confusion came about and how it can be resolved. I would like a more detailed and considered answer to my request that sheds light on how it is that OS think there is a right of way at the grid reference quoted and why you do not.
