Car Parking at Countryside Sites

In this report, the introduction of car parking charges to Conder Green Picnic Site, Lancaster; Springwood Picnic Site, near Whalley, Ribble Valley; and Wycoller Country Park near Colne was outlined. I noted you (wisely) chose to avoid using RTRA 1984 legislation to issue the Traffic Regulation Order and used the Countryside Act 1968 which rightly makes provision for councils to make charges at their Country Parks.

My questions are:

1.) Did these Country Parks already have off-street parking in place or did you have to issue a fresh Traffic Regulation Order using S32 of the RTRA 1984 which makes provision for introducing parking measures to prevent or relieve existing traffic congestion?

2.) Assuming you had the off-street parking already in place and just needed a method of introducing the parking charges without using the RTRA 1984, can you please tell me if the existing car parks were historically introduced using Section 32 of the RTRA 1984 or if they were ever added to an existing Traffic Regulation Order covering other off-street car parks under the control of LCC?

This enquiry is not to try and find out if you have acted in any way unlawfully with legislation, it is for comparison purposes in the public interest of making sure other councils introduce car parking charges using the legislation fit for purpose as you have done so with the Countryside Act 1968.

Further to your request for information, made under the provisions of the
above Act, please see below our response.

 

Request:

The Country Parks already had parking.  We did not have to issue a Traffic
Regulation Order as we did this under the Countryside Act of 1968. 

 

2.)   Assuming you had the off-street parking already in place and just
needed a method of introducing the parking charges without using the RTRA
1984, can you please tell me if the existing car parks were historically
introduced using Section 32 of the RTRA 1984 or if they were ever added to
an existing Traffic Regulation Order covering other off-street car parks

The car parks were introduced / created under various Acts, Wildlife &
Countryside 1949, Countryside Act 1968 and various land reclamation
programmes in the delivery of reclamation and recreation strategies.
