Eligibility For Help To Work Scheme

With reference to the SR HtW Implementation Memo 026 CWP Contingency 2014.
Issued: 11th December 2014
Subject: Widening the pool of Post-Work Programme claimants to ensure sufficient volumes are referred to Community Work Programme. In the designated contract areas, CPA11, CPA13, CPA15 and CPA18.

I note that Section 5 of this Memo states: 'The contingency requires all claimants currently receiving Post-Work Programme Support to be considered for referral, where their Work Programme Completer Interview (WPCI) was undertaken before 28 April 2014. This is the original date from which a WPCI must have been undertaken in order for a claimant to become eligible for CWP as part of the Help to Work package of measures.'

In the case of a claimant not subject to Mandatory Intervention, who undertook the original Work Programme under a standard JobcentrePlus Offer. Followed by the original 26 week Post Work Programme Support Scheme. Who was then formally signed-off at the end of the 26 weeks as having completed the PWPS scheme, and in addition advised verbally that he had done so by his advisor, (who also entered this fact into the online LMS record).
Following this, the claimant was then returned to normal fortnightly signing for a period of some nine months.

I ask therefore, on what legal basis this claimant, as above, who is clearly not receiving any current PWPS support, and has not done so for many months, having left the Work Programme entirely, can now be mandated using the contingency, to rejoin the Help To Work Scheme ?

CWP is primarily aimed at WP leavers. However, there is nothing in the Back to Work Schemes legislation that prevents DWP referring other groups.

Internal policy is simply there to manage the numbers of people entering the scheme.

The criteria for selection is simply:
CWP is aimed at long-term unemployed claimants whose key barrier to work is a lack of work experience or motivation, and is designed to enhance their CV, employability skills, and motivation.
