Department of Health unable to protect vulnerable people via Disclosure and Barring Service.

The request was refused by Department of Health and Social Care.

Dear Department of Health,

The Department of Health authorise the Care Quality Commission to use CRB disclosures and as such require people working with vulnerable people to have DBS checks, as this is the case lots of migrant workers are coming to the UK from war torn countries with no infrastructure.....

1) How does the DOH expect migrant workers to have enhanced DBS checks from war torn countries ?

2) What guarantee can the DOH give that migrant workers are checked thoroughly ?

3) Does the DOH have public indemnity insurance to cover policies requiring that the Care Quality Commission carry through with legislation ?

4) As the DOH police CQC, are you then responsible for the legislation requiring people to have mandatory DBS checks ?

5) Which government official is responsible for implementing that migrant workers can be thoroughly checked ?

6) How many migrant workers have been found to have criminal records from 2012 to 2015 ?

FreedomofInformation,

Dear Mr Danby,

Your questions relate to matters of policy and do not represent a valid Freedom of Information (FOI) request therefore they will be answered as correspondence (our reference DE00000937437).

The FOI Act is to do with transparency of information held by public authorities. It gives an individual the right to access recorded information held by public authorities. The FOI Act does not require public authorities to generate information or to answer questions, provide explanations or give opinions, unless this is recorded information that they already hold.

Dear Mr Gary Tempest,

Can you please elaborate and explain which questions relate to matters of policy and do not represent a valid Freedom of Information (FOI) request, as the questions can be changed to suit required information, rather than policy?

What questions generate opinions rather than transparency or requires opinions ?

This link >>>> http://www.express.co.uk/news/uk/578221/... gives answers to public interest and as such shows that the NHS Hospitals are employing people, who are dangerous. In other words Disclosure and Barring Services are letting down vulnerable people, as the UK checks "DO NOT" do world wide checks for criminal records!

My MP has also confirmed that the UK police national computer is only for the UK, so as this is a matter of fact, why is it not policy/common sense to answer relervent question that are of interest to the public". They also come under the Public Interest Disclosure Act 1998.

Yours sincerely,

Peter Danby and Associates

FreedomofInformation,

Dear Mr Danby,

The Freedom of Information Act 2000 is to do with transparency of information held by public authorities. It gives an individual the right to access recorded information held by public authorities. The FOI Act does not require public authorities to generate information or to answer questions, provide explanations or give opinions, unless this is recorded information that they already hold.

For the sake of clarity, recorded information includes printed documents, computer files, letters, emails, photographs, and sound or video recordings. Should you wish to submit a separate FOI request, please make certain to clarify exactly the information and/or documentation which you seek. Before doing so, however, I would advise consulting the Information Commissioner’s Office website: https://ico.org.uk/for-the-public/offici... (specifically the subsection entitled How should I word my request to get the best result?).

Yours sincerely,

The CQC recently visited a hospital I had the misfortune of be at. While my view are this place is hell on earth.

The CQC found not all staff had valid DBS/CBR checks. However did nothing! Making the CQC process a joke.
