Dear Home Office,

Can you please provide me with Eddy Montgomery's Mobile Telephone Bill for the last twelve months.

I wish to see a list of calls, duration ETC, internet access usage and so forth...

FYI, I am aware that his number is 07747093100 - so as to aid in your search.

I am aware that you will believe that his call history might well be a S.40 exemption, so Please do feel free to redact any telephone number that he has called, which is not a public telephone number.

(Just for reference's sake, I will also add that his Landline Numbers are:
0161 261 1250 (Manchester) and 0151 213 2188 (Liverpool)). Can you share his call history from these telephone lines over the last twelve month period also.

Dear Home Office,

I'm writing in response to my FOI request, 32931, which you refused as vexatious.

Firstly, you didn't include an attached file, which you referred to. Could you correct this please.

Secondly, well the issue I have is not to cause an annoyance, but to actually try and see why the tax payer is paying for Mr Montgomery's phone bill which is not related to a Civil Duty. Heck, I do wonder if we are paying for Mr Montgomery's personal email account [email address] too (Don't worry, thats redacted on WDTK ;) Just FYI).

So, I would be most grateful if you could confirm what we the tax payer are actually paying for on Mr Montgomery's phone bill... From personal knowledge I do know that Mr Montgomery is using his mobile for personal - non business - use, and the CPS is quite clear that such actions are actually considered theft - Please see:

Dishonestly obtaining electronic communications services -
Communications Act 2003, section 125
An offence under the Communications Act 2003 section 125, see Stones 8.30110, applies to a person who has obtained the benefit of a telephone or obtained access to the internet when there was no intention to pay for that service. It will invariably be preferable to charge this offence rather than one of dishonest abstraction of electricity. The section125 charge may be more appropriate than one of obtaining services dishonestly contrary to section 11 Fraud Act 2006; or a section 1 Computer Misuse Act 1990 unauthorised access offence.

Section 125 does not cover an employee dishonestly using an employer's telephone for private purposes as it is anticipated that the employer will pay the telephone bill; in such cases consider charging contrary to section 13 of the Theft Act 1968, see Archbold 21-164 et seq.

I know personally, that Eddy uses his HO issued mobile, to manage a (young player) football team. Whilst I think it's a great thing, with his wage, he should be paying for his own private calls.

I've raised my dispute directly to his "line management" - Mandie Campbell.

Remember people: We are all equal in law. If your employer can do you for theft RE: calls, then why can't their employer (us the tax payer) do them RE: theft.
