Thanks for your comment! you say my foi is pointless hmm ok however there is more to this foi. its about sanctions! its about mandatory reconsideration, there's a bigger picture. pointless? when dwp are the data controller for a4e? and john kennedy (a4e) says things like he says in that Clip ?

What FOI Act duty does the DWP have to listen to the tape? If a transcript was created of the tape http://youtu.be/bYuUqsySIIE and then associated request made for info from the DWP, then it might get a response beyond, 'we do not hold any information' specific to your request. Or other bland, 'please visit' www for our policy on data protection and contractors.

DWP Will listen to the recording as dwp are the data controller for a4e what part of that do you not understand?

FOI only applies to information that is already held by the organisation at the point you make the request. So asking them to listen to a clip and then provide information that they would inevitably have to *create* in order to answer the request is pointless.

Unless A4e have already done an assessment of compliance with Data Protection and DWP rules on this particular situation, this information will not be held. They would have to create it in order to answer your FOI request. Whatever the rights and wrongs of the situation, it's pointless to use FOI to ask for information that the organisation would have to create in order to supply. You won't what you're asking for.
