Dear Peterborough City Council,

It is the responsibility of the Local Authority to oversee Youth Offending Teams, produce Youth Justice Plans etc.
1. In terms of staffing what is the composition of your Youth Offending Team in terms of designated posts, numbers etc?
In particular I seek to establish how many HCPC registered social workers are within your team and the qualifications required of those from Probation, Health and the Police in addition to numbers and qualifications required of other members of your team. Please advise as best you can.
Please provide person specifications including that applicable to the Youth Offending Team Manager.
2. If you consider it appropriate please advise of the professional qualification of your current Youth Offending Team Manager.
3. Which Officers/posts within your team are designated to:
a. Attend the police station as an appropriate adult;
b. Hold case responsibility for children remanded to local authority accommodation with an indication if they have experience of managing looked after children;
c. Write pre-sentence reports;
d. Act as responsible officers for community sentences.

4. Please provide your guidance and policy that addresses dovetailing children in conflict with the law and Local Authority duties under the Children Act 1989 concerning children in need; children suffering or at risk of significant harm including threshold criteria; looked after children with particular reference to offences committed in residential care and children who are looked after but are sentenced to custody; looked after children subject to a pathway plan; children and young people who have ceased to be looked after together with arrangements for managing the transition to adult services.

Peterborough City Council’s Youth Offending Service (YOS) currently has
the following staff working under its direction, all are full time
equivalent:

 

5 - Youth Justice Officer

2 - Qualified Youth Justice Social Worker

3.3 - Resource Worker

1 - Bail and Remand Officer

1 - Family Intervention Worker

1 - Education, Training and Employment Officer

1 - Mental Health Worker

0.5 - Restorative Justice Officer

1 - Appropriate Adult Coordinator

1 - Sports Officer

0.5 - Referral Order Panel Coordinator

Please refer to Attachment 1 for the job descriptions and person
specifications held regarding these posts. It has been necessary to redact
some information which we consider to be exempt under Section 40(2) –
personal information. We believe the exemption applies because disclosure
of this information would not be fair or lawful because it would breach
the first data protection principle as outlined in Schedule 1 of the Data
Protection Act 1998, and we consider that this individual would have a
reasonable expectation of privacy.

 

In respect of Health and Care Professions Council (HCPC) registered posts,
there are three across the team. 

 

In respect of the Probation Officer secondment, there is an expectation
that they will be either social work qualified or have the equivalent
Probation qualification.

 

The Police Officer post is linked to experience as an officer rather than
a formal qualification.

 

The Health secondment depends on the secondee, but they will have a
relevant qualification in the discipline they represent.  At present
Peterborough has a consultant psychologist. 

 

There are no required qualifications for most other posts, however:

 

o managers are required to have a social work / probation qualification
or relevant other degree;
o the Sports Officer is required to have a qualification relevant that
field;
o the Mental health worker is required to have a qualification relevant
to their discipline (currently a Community Psychiatric Nurse
qualification); and
o the Bail and Remand Officer who is required to have a qualification in
working with young people, for example, Youth Work qualification.

 

     2. If you consider it appropriate please advise of the professional

     qualification of your current Youth Offending Team Manager.

 

We consider this information to be exempt under Section 40(2) – Personal
Information. We believe the exemption applies because disclosure of this
information would not be fair or lawful because it would breach the first
data protection principle as outlined in Schedule 1 of the Data Protection
Act 1998, and we consider that this individual would have a reasonable
expectation of privacy.

 

     3. Which Officers/posts within your team are designated to:

The Appropriate Adult Coordinator plus their team of volunteer appropriate
adults and a small number of trained sessional workers deal with this area
of work.

 

     b. Hold case responsibility for children remanded to local authority
accommodation with an indication if they have experience of managing
looked after children;

 

This is mainly held by the Bail and Remand Officer, but others in the team
also hold remands. The looked after element of any remand to secure
detention accommodation is managed by a social work team separate to the
YOS.  All have relevant experience in working with Looked After Children.

 

          c. Write pre-sentence reports;

 

The five Youth Justice Officers, the two Youth Justice Social Workers, the
Probation Officer and the Bail & Remand Officer all write pre-sentence
reports.

 

     d. Act as responsible officers for community sentences.

 

The same group as reported in ‘c’ above hold case work responsibility for
community sentences. 

 

     4. Please provide your guidance and policy that addresses

     dovetailing children in conflict with the law and Local Authority

     duties under the Children Act 1989 concerning children in need;

     children suffering or at risk of significant harm including

     threshold criteria; looked after children with particular reference

Thank you for your email dated 25^th May 2013 in which you expressed
dissatisfaction with our response, under Section 45 Code of Practice; we
are required to refer this to an internal review.

 

You have specifically asked:

 

I am requesting clarification in the hope that it will alleviate my
confusion concerning the principles that underpin your initial response.

 

Under Section 45 of the FOIA cod of practice, where a requestor expresses
dissatisfaction with a response, then the matter should be referred for an
Internal Review.

 

A senior manager or legal advisor who was not involved in the original
request will now carry out an internal review. We aim to handle simple
internal reviews in 20 working days, in this case by 24^th June 2013. We
aim to handle internal reviews that involve complex issues that require
further investigation and those that require consideration of the public
interest test, in 40 working days.

 

If you are dissatisfied with the internal review of our decision, or an
internal review was not available, you can seek an appeal from the
