Are there, or have there ever been, any discussions between you and/or your office/staff with any other police force/government agency/political party/the Home Office and/or members of the current Conservative government which focus(ed) in any way on information gathering/sharing for the purpose of classifying/recommending for classification and/or proscription of the Hunt Saboteur Association as Domestic Terrorists?

FREEDOM OF INFORMATION ACT 2000 – INFORMATION REQUEST

Thank you for your request for information, which I acknowledge was received by the Warwickshire Office of the Police and Crime Commissioner (OPCC) on the 9th November 2019.

Your request is currently being considered and if the OPCC is able to provide you with the information you have requested then under the Freedom of Information Act (FOIA) you are entitled to receive it within 20 working days, namely the 6th December 2019 in this instance.

For your information, the FOIA defines a number of exemptions which may prevent release of some or all of the information you have requested. The OPCC will assess your information request in light of the exemptions and if exemptions do apply, then the OPCC may decide not to release all, or part, of the information you have requested. I shall inform you if this is the case, and advise you of your rights of appeal.

If the information you request contains reference to a third party then they may be consulted prior to a decision being taken by the OPCC as to whether to release the information to you. Your request for information has now been considered and in seeking to
assist it may be helpful if I firstly clarify the position of the
Warwickshire Police and Crime Commissioner (PCC) in the matters that you
raise.

 

The PCC, Mr Seccombe, has been elected to represent the residents and
communities of Warwickshire in the areas of policing and crime. As part of
his role he has a statutory responsibility to secure an effective and
efficient police service and hold to account the Chief Constable for the
delivery of the objectives in the PCC's ‘Police and Crime Plan 2016 -
2021’. Warwickshire Police are in turn represented by the Chief Constable,
who has autonomy for all operational policing decisions including the
police response to incidents of crime and anti-social behaviour.

 

Given this clear distinction between the roles and responsibilities of the
PCC and Chief Constable, the issues under consideration are principally
for Warwickshire Police and not the Office of the Police and Crime

In specific response to the questions posed in your FOIA request, the
position of the Office of the Police and Crime Commissioner is as follows:

Q1. Please provide the list of priorities, by type of crime, which your

Response - This information is not held by the OPCC. Whilst the PCC's
objectives are set out in the attached Police and Crime Plan 2016 – 2021,
the OPCC does not prioritise nor allocate investigative resources as this
is entirely an operational matter for the Chief Constable.

 

Q2. I note that breaches of the Hunting Act are not recordable crimes as
per the police/Home Office Orange Book. Why is that omission in place, and
do you have plans to make hunting crime recordable for your force to
deliver open, transparent and fair policing?

Please be advised you that I am unable to provide the information
requested, and Section 12(2) of the Freedom of Information Act 2000, is
engaged
 
Section 12(2) states: Subsection (1) does not exempt the public authority
from it obligation to comply with paragraph (a) of section 1(1) unless the
estimated costs of complying with that paragraph alone would exceed the
appropriate limit.
It would be impossible to carry out searches within the fees limit
(£450/18 hours), that would enable me to comply with section 1(1)(a) FOIA
which states: Any person making a request for information to a public
authority is entitled - (a) to be informed in writing by the public
authority whether it holds information of the description specified in the
request
It would take an inordinate amount of effort to establish whether or not
Warwickshire Police holds any information relevant to your questions. Such
an undertaking would involve a disproportionate amount of effort and would
take us well over the Fees Limit (£450) which equates to 18 hours work at
a standard rate of £25 per hour, as stated in the Freedom of Information
(Fees and Appropriate Limit) Regulations 2004.  
 
This letter acts as a Refusal Notice for your request and if one part of a
request exceeds the fees limit then s12 of the Act applies to the whole
request.
 
Your attention is drawn to the below which details your right of
complaint.
