Dear Independent Office for Police Conduct,

Case [2023] EWHC 589 (Admin) concerns the judicial review of the Police Misconduct Panel decision relating to officer Imram Aftab who observed that a woman was “too curvy to be Asian” and who showed her his warrant card and photos of himself. The case concludes:

'156. There could only be one rational and reasonable disciplinary outcome from the
choice of this Officer to interact with a lone female member of the public unknown to him, in the way that he did, on 15 April 2020. That could not conceivably involve him continuing as a police officer.

My request relates to paragraph 1.35 of the Police Misconduct Panel's findings, set out in full in paragaph 20:

'1.35. In relation to the alleged facts at paragraph 8, the Panel does not find the facts proven, namely, that the officer showed the complainant photographs of himself wearing a police helmet, wearing an unbuttoned short and showing off his body. The AA bears the burden of proof of proving its case on a balance of probabilities. They have failed to discharge this burden regarding the alleged nature of the photographs being of an inappropriate or sexual nature because the IOPC investigation was deficient in failing to ask for the photographs from the officer.'

The IOPC does not hold information under your request. There was no learning for the IOPC as a result of this finding by the Panel.
