Dear East Riding of Yorkshire Council,

East Riding of Yorkshire Council (ERYC) is the billing authority empowered to collect and enforce payment of any 1.5% levy on businesses within its area whose premises have a Rateable Value in excess of £12.5K. Such levy payments constitute the principal revenue stream of Business Improvement Districts (BIDs) within the Council's operating area. It follows that the probity of the incorporation and operating methods of such BID companies is of the greatest public interest.

Without the expectation of the disclosure of personal data (including names), and granting the Council's duty to redact personal data as required by the GDPR, I am hereby requesting such information as is held by the Council which documents/records the following material evidence pertaining to the Council's due diligence regarding the incorporation of any Business Improvement District (BID) within the Council's operating area:

1) all documentation/records referring to to the incorporation of any BID within the Council's operating area;

2) all documentation/records referring to the appointment of the Chair of any BID within the Council's operating area, including the setting of salaries, pensions, disbursements and other emoluments;

3) all documentation/records referring to the appointment of the Chief Executive Officer of any BID within the Council's operating area, including the setting of salaries, pensions, disbursements and other emoluments;

For the avoidance of doubt, the information I am requesting includes such evidence as the Council holds which in any way demonstrates that the Council has exercised due diligence in the matter of ensuring that:

4. 1) the Council's Duty of Care to businesses within the Council's operating area has included the necessary checks regarding the legal authenticity of the processes of recruitment employed by any BID within the Council's operating area; and

4.2) the Council's Duty of Care to businesses within the Council's operating area has included active investigation and subsequent confirmation that any BID's contractual obligation to provide so-called 'Baseline Services' under the terms of any Agreement entered into by the ERYC and any BID company has been fulfilled.

ERYC will be aware that Scarborough Borough Council (SBC), being the lead authority in a BID within its area of operation, is presently engaged in an exhaustive investigation, by way of its Overview & Scrutiny Board, into the ballot process relied upon to authorise the incorporation of a BID within its own operating area. The information I have requested will inform that process and is therefore time sensitive.
