behalf of NSS. Your request is in the following terms: -
Please provide detail of all assessments undertaken by NHS National
Services Scotland to scope the potential financial risk to NHS NSS from
litigation brought by past patients of the Sandyford Gender Identity
Service.
In terms of Section 17 of the Freedom of Information (Scotland) Act 2002,
I can advise that NSS do not hold any relevant information in relation to
your request. It should be noted that if any such information was held
then it would likely be exempt from disclosure in terms of Section 36 of
the Act as it would amount to confidential communications for which such a
claim to confidentiality could be maintained in legal proceedings.
However, in an effort to assist further I can advise you that there are no
active litigated cases or claims relating to the Sandyford clinic
currently being dealt with by CLO.
