Response to this request is long overdue. By law, under all circumstances, Defence Infrastructure Organisation should have responded by now (details). You can complain by requesting an internal review.

Dear Defence Infrastructure Organisation,

I would be grateful if you would provide a copy of the following work orders:

1. Construction of a fence at training area B4/Long Valley. This fence was constructed on or around 27th of March 2020 and runs along the western edge of Rushmoor Road.

2. Installation of access gates in the fence referred to in 1. above. The gates were installed in September 2020.

In addition to the work orders please provide a summary of costs incurred. If possible a breakdown of labour and materials for each work order would be of interest but I will accept individual summary totals.

I believe such costs are not recurring and therefore may be disclosed under FOI.

Thank you for the information supplied - however some requested information is missing.

The fence installation (Question 1) has been answered and the works order information received.

The installation of gates (Question 2) has not been answered and the works order information appears to be missing.

To clarify; the fence was installed in March 2020. The additional gates were installed in September 2020.

Please supply works order information instructing installation of gates (as originally requested) as per question 2.

Please let me know if the scope of request is not clear.

Further examination of the documents highlights errors and missing or incomplete data:

Annex B of the response has no data for the Task Order Unique Identifier.

Annex B Section 10 Endorsements of the response is undated and unsigned.

Whilst noting signature may be considered personal data all other fields are within the scope of freedom of information.

I would therefore be most grateful the complete document could be forwarded?

Dear Mr Brown,

We acknowledge receipt of your emails of 23 and 31 December, which have been passed to this office in order to complete an independent internal review of your request handled under the FOI Act, our reference FOI2020/13389.

The Department's target for completing internal reviews is 20 working days from date of receipt and we therefore aim to complete the review and respond to you by 26 January 2021. While we are working hard to achieve this, in the interests of providing you with a realistic indication of when you should expect a response, the majority are currently taking between 20 and 40 working days to complete. The review will involve an independent assessment of the handling of this request and the outcome.

We should also advise that the measures implemented by the Department to prevent the spread of COVID-19 may continue to impact upon our ability to complete the review within the above timescale but we will aim to provide you with an update, if necessary.

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Defence Infrastructure Organisation's handling of my FOI request 'Work Orders for Fencing at Long Valley/B4'.

The information supplied remains incomplete and does not fully satisfy point 2 of the original request. All material supplied refers to TWO gates yet since September 2020 a total of FIVE gates are in existence in the Rushmoor Road deterrent fence.

The information supplied, and specifically LMSON017461, SoN 1134720 & Work Task 1133488 are consistent in requesting two vehicle gates are to be supplied and installed. These gates were installed in March 2020 as part of the work to install the deterrent fence.

In September 2020 three additional pedestrian gates were installed. Information relating to this change to the estate is noticeable by its absence.

Please provide and expedite the release of the information regarding the installation of the three additional pedestrian gates - as per the original request.

Thank you for your reply.

The original FOI request made no distinction as to who incurred the costs, but does request "if possible" a breakdown and the costs associated with three additional foot gates are clearly within scope.

A straightforward breakdown of costs - fence and all gates - will be simple and straightforward to obtain and as they are clearly identified as to who holds the record delivery of the requested information - in full will be both expeditious and within cost of compliance limits.

As a one-off cost (installing gates) this should not be subject to qualified exemption. Landmarc is a private business, but supplies management and contracting services to DIO...so whilst the information is held by Landmarc its held on behalf of DIO and thus remains DIO's responsibility to disclose.

Finally, I will take this opportunity to remind DIO that it is a criminal offence deliberately destroy, hide or alter requested information to prevent it being released.

I wish to clarify my request for internal review:

The original FOI request made no distinction as to who incurred the costs but does request "if possible" a breakdown and the costs associated with three additional foot gates are clearly within scope.

Furthermore, no distinction is in the request as to who installed the foot gates or holds the paperwork required. I am under no doubt the installation of three foot gates (plus signage) will have triggered the creation of paperwork to facilitate the sourcing and installation.

If the claim is correct, Landmarc installed the foot gates under direct instruction and on behalf of DIO. Therefore the responsibility for producing and providing the requested documents remains the sole responsibility of DIO.

To fully satisfy this request all documentation within scope must be provided, in addition to the cost breakdown previously outlined.

To reiterate; I will take this opportunity to remind DIO that it is a criminal offence - both corporate and individual - to deliberately destroy, hide or alter requested information to prevent it being released.

Your complaint is subject to an ICO investigation and we would, therefore, not normally complete another internal review. Instead, it is now for the ICO to decide whether MOD has complied with your request.
