Please provide a copy of the lease for Wirral Transport Museum which the media report as having been granted to Big Heritage CIC.

Please also provide details of how the decision to grant the lease to them was reached.

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'Wirral Transport Museum Lease'.

Reasons for requesting an internal review:-

My original request was -
‘Please provide a copy of the lease for Wirral Transport Museum which the
media report as having been granted to Big Heritage CIC.
Please also provide details of how the decision to grant the lease to them
was reached.’

In response you have only provided a lease.

That lease references rent at various points but I cannot see what the rent is, please provide details of that.

Also you have not responded to my request for details of how the decision to grant the lease to them
was reached, please respond.

A copy of the lease was provided as per your request.

 

A link was also provided to the Committee documentation which provides a
response to the other part of your request regarding decision making.

 

It is the Council's position that we have responded in full to your
request.

 

As for your new question regarding rent, this will be logged as a new
request and a response will be issued within 20 working days.

Dear InfoMgr, FinDMT,

I do not think it was at all unreasonable for me to entirely expect that the lease would include detail of the rent and that the decision to grant the lease would include reference to a consideration of the level of the rent, and so to not give any thought to having to include additional specific questions within the request regarding that.

In dealing with foi requests you have a duty to advise and assist, including where you are privy to unusual information that clearly affects a request and which a requester could not possibly know, such as where a lease and the decision to grant a lease do not include reference to the actual rent and setting it at that level. Instead I yet again face unnecessary delays in obtaining information.

Please provide full detail of the rent and full information on the decision to grant the lease at such level of the rent.

At the end of paragraph 5.3 the report says –
‘Independent valuation advice has indicated that the typical market rent for museum attractions is a peppercorn, so based on the restricted use, the proposed rent does meet the market rent and therefore would meet the requirements under Section 123.’

Please provide a copy of that independent valuation advice.
