Wirral leisure centres dec, dec-rr, acic

Waiting for an internal review by Wirral Metropolitan Borough Council of their handling of this request.

Dear Wirral Metropolitan Borough Council,

I have searched online at

https://www.gov.uk/find-energy-certificate

for DEC display energy certificates, DEC-RR display energy certificate recommendation reports and ACIC air conditioning inspection certificates for six Wirral leisure centres.
It looks like none have ACIC, and the DEC and DEC-RR they do have are all expired, some very long ago.

For each of the six leisure centres –

Europa Pools Leisure Centre, Conway Street, Birkenhead, Wirral, CH41 6RN
West Kirby Concourse Leisure Centre, Grange Road, West Kirby, Wirral, CH48 4HX
The Oval, Old Chester Rd, Bebington, Wirral, CH63 7LF
Leasowe Leisure Centre, Twickenham Drive, Leasowe, Wirral, CH46 1PF
Bidston Sports and Activity Centre, Valley Road, Bidston, Wirral, CH41 7EJ
Guinea Gap Leisure Centre, Riverview Road, Wallasey, Wirral, CH44 6PX

Please provide or confirm for each of the six leisure centres –

1 copy of or link for the latest DEC and confirmation of where it is displayed at the leisure centre
2 copy of or link for DEC-RR
3 copy of or link for ACIC
4 or confirmation for the reasons why any of these DEC, DEC-RR and ACIC are not required
5 information as to what enforcement action the council as the local authority responsible for enforcing these standards has taken, including details of any fines it has levied against itself or anyone else for any failures here
6 information as to what enforcement action the council as owner operator of the leisure centre or anyone else has faced, including details of any fines have been levied against it and any fines it has paid for any failures here
7 or confirmation that any enforcement action or fines do not apply at all or do not apply to the council
8 information as to any consideration the council has given to any failings here
8 information relating to any consideration of the impact of any failings here by the council, may or has had on the level of adherence to similar requirements for energy certificates by local business and public, the level of trust and confidence local business and public have in the council’s implementation of such similar requirements, and on the council’s ability to continue to effectively enforce such similar requirements without detriment.

It is now 20 working days since my 12/06/2024 request for information and you have not responded at all.

We have strong reason to believe that the name used in your requests is a
pseudonym. We have previously sought proof of identity from you under
[1][email address] and no response was
received.

 

Section 8 FOIA describes the criteria that a valid request under the Act
must meet, specifically Section 8(1)(b), which states that a valid request
will ‘state the name of the applicant’. The ICO has produced guidance
regarding this part of the Act, stating that:

 

“A requester can be an individual, a company or an organisation, but in
each case Section 8(1)(b) requires that a request for information must
include the name of the requester. In our view, the intention of the
legislation is for the requester to provide their real name so their
request could be processed in accordance with the requirements of the
FOIA.”

 

We therefore consider this request is invalid as it fails to meet the
requirements of Section 8(1)(b) FOIA.
