Dear Wirral Metropolitan Borough Council,

Please follow this link to a recent news item in the Wirral Globe relating to a Channel 4 Dispatches programme which will be probing Wirral Council on Monday 14th June 2013:

Contained within is a list of senior officers, drawn from a council media statement, who recently departed the council.

1. Please provide the level of severance payment (including all the usual components) given to each of the following officers. I've inserted the released figure for two officers, David Green and David Taylor Smith, whose severance payments became public knowledge yesterday (14th June 2013)

David Green, Director of Technical Services(£103,234.60)
David Taylor Smith, Deputy Director of Finance(£68,660.39)
Ian Brand, Head of Asset Management
Geoff Paterson, Head of IT Services
Jim Lester, Head of Cultural Services
Rob Beresford, Head of Regulation

2. Please also confirm whether any of these officers received / signed or are otherwise subject to any of the following:

o A clean bill of health in the form of a reference

o A compromise agreement / contract

o A gagging clause within their full & final settlement, which prevents them from talking to anybody about the circumstances leading to their departure (outside the customary circle of: professional advisers; union reps; direct family; HMRC)

hi Paul, I look forward with bated breath to the Dispatches program tomorrow night & hope the councilors & officers are vilified to the enth degree which will be truly deserved & could I suggest that you go onto Radio Merseyside Roger Phillips chat show between 11.30 & 2.00 & get your points over & publicize the channel 4 program to the maximum & wirral residents will be made aware publicly of the councils shortcomings. All the best with your requests & hopefully you will be at nigel Horbro's meeting in new brighton a week on wednesday so at least I can put a face to the globe & FOI requester.Cheers for now john hardaker.

The Council does not consider it is appropriate to disclose this
information. This information is personal data, relating to the data
subjects, and it is considered that the information requested is exempt
information under Section 40 (2) of the Freedom of Information Act.  The
Council considers that the disclosure of the requested information would
contravene the first data protection principle, that personal data shall
be processed fairly and lawfully, and shall not be processed unless at
least one of the conditions in Schedule 2 of the Data Protection Act 1998
is met. We consider disclosure of the requested information would have an
unjustified adverse effect on the officers.

 

o A compromise agreement / contract

 

David Green, Director of Technical Services signed a compromise agreement.

 

o A gagging clause within their full & final settlement, which prevents
them from talking to anybody about the circumstances leading to their
departure (outside the customary circle of: professional advisers; union
reps; direct family; HMRC)

 

There is no ‘gagging clause’ in the compromise agreement signed by Mr
Green.
