Thank you for your emails received in this office on 15^th January 2018
requesting information on the Winter Festival Events 2017 TC044 Lot 2 -
Giant Snow Slide.

 

In cases where an authority receives 2 or more requests for same or
similar information it may, under the Section 5 (2) of the Freedom of
Information and Data protection (Appropriate limit and Fees) Regulations
2004 (the “Fees Regulations”), aggregate the request for the purpose of
determining cost of compliance.

 

The Fees Regulations state that two or more requests to one public
authority can be aggregated for the purposes of calculating costs if they
are:

 

o by one person, or by different persons who appear to the public
authority to be acting in concert or in pursuance of a campaign;

 

o for the same or similar information; and

 

o the subsequent request is received by the public authority within 60
working days of the previous request.

 

The intention of this provision is to prevent individuals or organisations
evading the appropriate limit by dividing a request into smaller parts. In
line with the Fees Regulations the council will therefore aggregate your
requests for the purpose of determining the cost of compliance.

I am writing to make an open government request for all the information to
which I am entitled under the Freedom of Information Act 2000.

 

Can you supply the final price Charged to Bolton Council (not the original
winning Tender price) by Pro Marquee Events Ltd. For the Lot 2- Giant Snow
Slide.

Bolton Council has considered this element of your request and feels that
the information you request is exempt from disclosure under the Freedom of
Information Act 2000 (“the Act”).  Section 17 of the Act provides that
when refusing a request, Bolton Council must provide a notice which (a)
states that fact, (b) specifies the exemption in question, and (c) states
(if that would not otherwise be apparent) why the exemption applies.

 

In this case we consider that the exemption under section 22(1)(a) of the
Act applies to this information.  Section 22(1) (a) provides an exemption
where information is intended for future publication. Bolton Council has a
dedicated webpage in which reports for purchases over £500 are displayed.

The payment in question here will be contained in the February 2018 report
which is due to be uploaded to the Councils website by the end of April
2018.

 

As Section 22 is a qualified exemption, we are also required to decide, on
a case by case basis, whether the public interest in maintaining this
exemption outweighs the public interest in its disclosure. Bolton Council
recognises the public interest in our disclosure log as it provides the
public with access to information disclosed via the Freedom of Information
Act. We acknowledge that information provided under the Freedom of
Information Act has an inherent public interest in disclosure. However, we
consider that the public interest is met as this information is regularly
published by our Council. We have the intention to provide the information
via our usual publication method, mentioned above, in due course and
cannot see any specific public interest in providing the data sooner than
usual. On balance, we therefore consider that this exemption should be
maintained on this occasion.

 

In accordance with the Act, this constitutes a refusal notice for this
part your request.
