On the 29th August 2018 you awarded a contract for the Transport Infrastructure Delivery Plan - via ESPO framework 664 Consultancy Services lot 5.

Please provide a copy of the winning bidders quality submission only. Please exclude any business sensitive information such as commercial / financial information or personnel information.

For your information, the Act defines a number of exemptions which may prevent release of the information you have requested. There will be an assessment and if any of the exemption categories apply then the information will not be released. You will be informed if this is the case, including your rights of appeal.

If the information you request contains reference to a third party then they may be consulted prior to a decision being taken on whether or not to release the information to you. You will be informed if this is the case.

There may a fee payable for this information. This will be considered and you will be informed if a fee is payable. In this event the fee must be paid before the information is processed and released. The 20 working day time limit for responses is suspended until receipt of the payment.

Your request for information has now been considered and it is not possible to meet your request.

In accordance with the Freedom of Information Act 2000 this letter acts as a Public Interest Refusal Notice.

It is considered that the public interest in withholding the information outweighs the public interest in disclosing it.

The exemption applied is Exemption 43(2)

This exemption applies because: .Section 43(2) exempts’ information whose disclosure would, or would be likely to, prejudice the commercial interests of any person (an individual, a company, the public authority itself or any other legal entity).

The reasons why the public interest favours withholding the information, in order to redact all of the commercially sensitive information would exceed the appropriate limit.

I apologise that your request will not be met but if you have any further information needs in the future then please contact me.

You have the right of appeal against the decision. If you wish to appeal please set out in writing your grounds of appeal. I will arrange for an internal review which will be considered as part of Stage 3 of the Council’s complaints procedure.
