Request Reference: RFI-2013-0365
Your request for information about Wind turbine household consultation information has now
been considered. The information held by the Council relevant to your request is set out below:
Please can you provide information which details which households were formally notified of the
planning application by letter for a wind turbine at Wigsley Old Airfield?
Please see the attached spreadsheet containing a list of the neighbours that were consulted.
In addition, can you provide information which details the criteria used for selecting these
households and why?
Can you also provide information which details how you identified the households which are
closest to the proposed wind turbine site?
The statutory procedure in respect of publicising planning applications is contained within The
Town & Country Planning (Development Management Procedure) (England) Order 2010. In
respect of this type of application, the Order states that a site notice should be displayed in at
least one place on or near the land to which the application relates or by serving notice on an
adjoining owner or occupier.
As no property(s) ‘adjoin’ the application site, the Local Planning Authority had no statutory
duty to notify any property directly by letter. However we do endeavour to notify those that we
consider to be in close proximity. ‘Close proximity’ is obviously open to interpretation, but we
do try and include the nearest properties.
In order to notify other residents in the wider area of the proposed wind turbine at the
application site, the Local Planning Authority:
•
Placed two site notices in close proximity of the application site; one on Spalford Road
and another on Wigsley Road; and
•
Advertised the application in the Newark Advertiser; and
•
Consulted the Parish Council
The level of publicity that was afforded to this application therefore exceeded the statutory
requirements that are imposed by Central Government.
