Dear Miss White,
This is to advise you that we (Wiltshire Council), will be aggregating
your requests under The Freedom of Information (FOIA) and Data Protection
(Appropriate Limit and Fees) Regulations. By aggregating the requests the
total cost to the authority would exceed the appropriate limit of £450, so
the requests will not be processed any further. Your requests 202000261,
202000372, 202000514, 202000580, 202000581 + 202000582 were all received
by us within sixty consecutive working days, and this means we will deal
with all six requests as one. Under our Section 16 obligations (duty to
assist), we would like to provide advice and assistance which you will
find in the table below:
Case reference Date received Date closed Response
202000261 21/07/20 11/08/20 Policy provided
202000372 17/08/20 23/09/20 Refused - Section 12. Internal

202000580 23/09/20 Wiltshire Council holds the
information you have requested,
however, Section 21 of the Act
removes the obligation to provide
you with the information as it is
reasonably accessible to you by
other means. Section 21 is an
absolute exemption meaning no
public interest test is
necessary.

202000581 23/09/20 Some information held. The
schools themselves have the duty
to arrange some provision for
learners unable to attend school.
The MNERS (Medical Needs and
Re-integration Service) does not
provide advice on accessing
funding to schools. We only offer
some provision to those who have
been signed off by a consultant
as unable to attend school.
Advice and guidance provided
would relate specifically to an
individual and therefore, any
release made under FOIA is a
disclosure to the world and not
just to the individual making the
request. Information that
constitutes personal data is
exempt under section 40(1) of the
FOIA if it is about the applicant
(yourself); or section 40(2) if
it the information is about a
third party and where one of the
conditions listed in section
40(3A)(3B) or 40(4A) is met. In
this instance the relevant
condition is contained in section
40(3A)(a). This applies where the
disclosure of the information to
the public would contravene any
of the data protection principles
set out in Article 5 of the
General Data Protection
Regulation (GDPR). The council
believes that disclosure of the
requested information would not
be lawful or fair because it
would breach Article 5(1)(a) of
the GDPR.
202000582 23/09/20 Information not held - The
schools themselves have the duty
to arrange some provision for
learners unable to attend
school. The MNERS (Medical Needs
and Re-integration Service) does
not provide advice on accessing
funding to schools. We only offer
some provision to those who have
been signed off by a consultant
as unable to attend school.
However, this only applies to
children of compulsory school age
(i.e. not 6^th form). Therefore
no information held for Salisbury
Sixth Form.
We would like to put you in touch directly with a member of the SEND team
in order for you to discuss the specific information you are seeking. FOIA
does not appear to be the appropriate route for you to obtain the
information. Please get in touch with us via another means (not a public
facing website), so that we can give you the contact details.
Alternatively, please provide us with your telephone number and we will
ask them to phone you directly.
Kind regards,
Kyle McCormack
