Please may I request a copy of the Orders and plans associated with the Public Spaces Protection Order Extension No. 3 of 2020 (made under Section 60 of the Anti-Social Behaviour, Crime and Policing Act 2014) which came into force on the 20th October 2020 as advertised in the Wigan Observer on 27.10.20

I am emailing to confirm the receipt of your recent request for
information to Wigan Council. This has been logged with reference
indicated above and will be forwarded to the relevant department for
action.

We will respond as soon as possible and in most cases no later than 20

The Information Commissioner’s Office has recognised the unprecedented
challenges all are facing during the pandemic and that people may

current situation.  This is because the Council’s resources are focused on
ensuring that at risk and vulnerable residents are supported at this time.

The Council does not charge for most FOI requests, but charges may be made
for actual disbursements incurred such as photocopying, printing, postage
and packaging, and only if these charges amount to more than £20.00. If a

provision of the information.

I believe I have not been provided with the correct information. My request was for the Order and maps relating to Public Spaces Protection Order Extension No. 3 and the information I was given was for Public Spaces Protection Order Extension 1 & 2 of 2020. To clarify, I am requesting the Order and all the maps relating to Public Spaces Protection Order Extension No. 3 which has extended, for a further period of three years, all the Public Spaces Protection Orders (formerly known as Gating Orders) No. 1 – No. 322

Dear Mr Chung,

The service has advised that each order is on a separate case file and contained within it is the sealed order, map and all the consultation document so the actual names and addresses and signatures. They would need to go through 322 orders and extract the information you want (i.e. the maps) which would exceed 18 hours. Where this is the case, section 12 of the Freedom of Information Act 2000 relieves the Council from the obligation to comply with the request. The service has suggested that they can supply the current order and an excel spreadsheet with the locations on. Can you please confirm if that would be acceptable? If not, I will issue a refusal notice based on section 12.

In accordance with ICO Guidance, please note that the time for compliance will not begin until we have received the necessary clarification to enable us to answer your request. Under Section 1(3) of the Freedom of Information Act, if no clarification is received within two months of this e-mail, it will be assumed that you have decided not to pursue this request for information and this enquiry will be closed.
