Why did you refuse to investigate doctors involved in a killing?

This FOIA request is in respect of the pre-meditative killing of my father, Ralph Winstanley in April 2004.

It took place in his home, in the front room of Grange Farm,Pinfold Lane, Moss, Doncaster on 23 April.

1. Dr Kevin Michael Stewart Lee

When I asked the GMC to investigate the practise of the on-call doctor, Dr Kevin Michael Stewart Lee, who had prescribed 'terminal care' to my father, without ever seeing him; with no acess to his GP or Consultant's records, the GMC refused to investigate what had happened.

In view of the fact that the decision of Dr Kevin Michael Stewart Lee, of Danum Doctors Services Limited and of the Scott Practice, Balby, resulted in my father's untimely death, I wish to know - under FOIA -

a) why that investigation was refused by the GMC, in spite of the fact that Dr Kevin Michael Stewart Lee had neve met Ralph Winstanley nor had any information or access to his GP or Consultalts' Records, before deciding to help him to die?

b) Why the GMC refused to investigate the actions of Dr Kevin Michael Stewart Lee, in that not having met the 'patient, (together with Oramorph, which records clearly show, he was still fully aware (and approved) was being given by mouth to the 'patient')and having already prescribed Injections of Diamorphine and Haloperidol, he also recommended that a syringe driver should be set up to deliver Diamorphine and Haloperidol over a 24 hour period?

c) why the GMC refused to investigate the actions of Dr Kevin Michael Stewart Lee, who later on the same day - and still without ever attempting to meet the 'patient' or gain access to the 'patient's' records, Dr Kevin Michael Stewart Leed decided to add to the drugs load of Dianmorphine and Haloperidol (together with Oramorph, which records clearly show, he was still fully aware (and approved) was being given by mouth to the 'patient') he also decided to have him injected with Midazolam and to have a second syringe driver set up in the opposite leg to deliver Midazolam over a 24 hour period?

d) why the GMC refused to investigate why Dr Kevin Michael Stewart Lee made so overall a 'blind' decision, against an elderly, very vunlerable patient, in his own home, on no morethan the request of that 'patient's' lying wife, Nina Anne Clayton?

2. Dr Rachel Sarah Sykes

I also made complaint against Dr Rachel Sarah Sykes of Stainforth and Barnby Dun, Doncaster, who in spite of the clearly shown information within her GP Medical Records in respect of Ralph Winstanley, which she could easily have checked with the two Consultants, at Doncaster Royal Infirmary, chose to continue the killing of my father, even to adding Hyoscine hydrobromide, and - presumably to telling Dr Gillian Mary Harding that he was 'dying of 'terminal oesophageal cancer' when he had no such thing, as his Pathology Rport clearly shows. This woman should have been struck off, since she is a positive danger to all patients, if she lies to relatives about patient's' conditions.

I wish to know - under FOIA -
a)why the GMC refused to investigate what information was known to Dr Rachel Sarah Sykes?
b) why the GMC refused to investigate why she deliberately helped to kill Ralph Winstanley, in spite of his GP Medical Records, which clearly showed that he had not been dying?
c) why the GMC has thus far refused to investigate her actions against her very vulnerable, elderly patient?
d) why the GMC has refused to investigate the reasons why Dr Rachel Sarah Sykes refused to remove Ralph Winstanley to hospital as a place of safety?

3. Dr Gillian Mary Harding

In respect of the Medical Director of St John's Hospice, Balby Doncaster, Dr Gillian Mary Harding, who lied to Ralph Winstanley's two daughters, as she helped to kill him, I need to understand

a)why did the GMC refuse to investigate the actions of this doctor, who I note has since been put on special measures by the GMC, for (I understand) her drinking problems?

When she was helping to kill Ralph Winstanley, she presented herself as the 'Specialist opinion on the health of Ralph Winstanley', which she most certainly was not.

She also recommended that Dr Rachel Sarah Sykes, should next add to the drugs-load of Ralph Winstanley by injecting him with Hyoscine hydrobromide, on top of the several days of Oramorph, Diamorphine, Haloperidol and Midazolam, which he had been forced to accept whilst being kept without either food or fluid.

I wish to know - under FOIA -
b)why did the GMC refuse to investigate the reasons why she lied to us as Ralph Winstanley's daughters?
c) why did the GMC refuse to investigate why she misrepresented herself as any sort of 'speacilaist' on Ralph Winstanley's health?
d) why did the GMC refuse to investigate why she recommended Dr Rachel Sarah Sykes to inject him with an unspecified amount of Hysocine hydrobromide, when he was showing no signs of distress, but was only dying under an enoromous and killing drugs load?

d) why did the GMC refuse to investigate why she refused to remove Ralph Winstanley to hospital for his own safety?

4. Dr Tony Baxter, Director of Public Health, Doincaster East PCT

In respect of the approach made to Doncaster East PCT: under FOIA, I wish to be told
a) why did the GMC refuse to investigate the actions of Dr Tony Baxter, Director of Public Health, who when desperately asked for help, refused to give any help, but referred the case back to Dr David Brown of Stainforth Surgery and Branby Dunn Surgery, Doncaster?
b) why did the GMC refused to investigate why Dr Tony Baxter, Director of Public Health at Doncaster East PCT refused to remove Ralph Winstanley to a palce of safety in hospital?

5. Dr David Brown, GP, Doncaster East PCT PEC; Caldicott Guardian

In respect of Ralph Winstanley's GP, Dr David Brown of Stainforth Surgery and Barnby Dun Surgery, Doncaster - also PEC Doncaster Eat PCT and its Caldicott Guardian for months following a formal complaint after Ralph Winstanley's killing,

a) why did the GMC refuse to investigate the actions of Dr David Brown, who - as shown by the GP Records - was fully aware that Ralph Winstanley had not been dyiing?
b) why did the GMC refuse to investigate the incompetencies - or deliberate actions - of Dr David Brown, when he neglected to accurately record the test results gained on Ralph Winstanley, following the two gastrological investigations made by Consultant, Dr Gary James, and which clearly showed no sign of any malignancy in Ralph Winstanley's oesophagus?
c) why did the GMC refuse to investigate the reasons why Dr Brown intubated Ralph Winstanley's bladder, when he was showing no sign of any urinary problem - except for that reported - secretively - by Nina Anne Clayton?
d) why did the GMC refuse to investigate the number of anomalies clearly shown within the GP Records which Dr David Brown had made in respect of Ralph Winstanley?

I wish to be given a full and unwavering truthful answer since on that answer hnges the safety of many old, ill and vulnerable people.

All of the people named above and in my more explanatory original approach to you, have acted against all medical reason and were instrumental in procuring the death of my father.

I consider that the fact that your body - the GMC - has allowed and encouraged these so-called 'professionals' to continue practicing on the old, ill and vulnerable, does the GMC no credit, and has placed many people at serious risk of harm, for the last seven years and five months.

was killed, when he had not been dying, I have needed because of their intransigence, to play a series of fencing matches with the people who it is claimed are in place 'to oversee our safety, when faced with 'professionals' who act against their own remit'.

Not one of the organisations approached has ever taken the line that killing an old man is wrong. Not one of them has ever investigated, in spite of very clear and overwhlming evidence which shows:

1. Who set up this deliberate killing

2. how this killing was achieved

3. which 'professionals' acted either incompetently or with ill-will towards Ralph Winstanley

5. which professionals refused to investigate this deliberate killing

6. which 'professionals' refused to investigate the actions of those 'professionals' who have acted totally against their publicly stated job remit.

The result of this is that I have no trust left in anyone.

Even the Information Commissioner, Mr Graham, is taking a stated 20 weeks before any of his staff will BEGIN to look at any complaint.

This appalling state of affairs, is something for which we, as the public, pay dearly.

it leaves us unsafe in our beds and unable to rely on any public service.

Having written - yet again - via FOIA in August last year for an explanation - see above - I note that I have never yet had any satisfactory response from the GMC in respect of its refusal to investigate the deliberate killing of my father, Ralph Winstanley ( http://ralphwinstanleyofwath.blogspot.com ) who was prescribed Terminal Drugs, by Dr Kevin Lee of Doncaster, for a condition which he did not have. He had not been dying, when Dr Kevin Lee was persuaded - never having met him - and not meeting him then - to prescribe Termnal Care, which took six excruciating days and nights to kill a man who, even had he been dying, was very clearly stating to nurses, that he was not in any pain and was trying to refuse the needles and drugs.. as I saw.

I am sure that you will be interested to know that Dr Kevin Lee of The Scott Practice, Balby, Doncaster, seems to have helped someone else out as well. The man in teh Doncaster Free Press article - below - is stated, by HM Coroner to have been having a heart attack, but Dr Lee did not recognise it nor help him.

The end result in both cases of what I can only see as 'ineptitude' was that these two men died.

1. I now wish to be told, under FOIA, the reason why the GMC has not acted thus far, in respect of Dr Kevin Lee.

2. Also I wish to know at what point the GMC will be persuaded to act?

3. Does a 'three strikes and you're out' policy apply?

4. I now want a full internal review of all dealings and non-dealings by the GMC in respect of the death of Ralph Winstanley, the responses given, and the lack of investigation of the first case, which allowed - one might say - the application of what looks like a lack of care in the second case - below.

I would be grateful if you would deal with this as a matter of urgency.. and this is your public warning on the matter.

HEALTH bosses have launched an investigation after a well-known Doncaster GP failed to spot a man had suffered a heart attack days before he died.
Dr Kevin Lee instead prescribed the man, who was complaining of shooting pains in his chest and arms as well as breathlessness, anti-biotics for a chesty cough, an inquest heard.
The GP also failed to carry out checks for blood pressure and a pulse during the ten minute examination, the hearing was told.
Dean Beresford, 44, who had also consulted other medics over his symptoms died after collapsing.
Coroner Stuart Fisher said there were four “missed opportunities” to get Mr Beresford, of Gainsborough, emergency treatment.
Following the hearing a spokesman for Doncaster Primary Care Trust, confirmed Dr Lee was a GP at The Scott Practice in Balby, and health bosses would be looking at the coroner’s findings.
He added Dr Lee had kept the trust “fully informed through the process.”
Rose Fells, managing partner of The Scott Practice, said: “Dr Lee would like to offer his condolences to the family of Mr Beresford. He is unable to comment further due to patient confidentiality.”
The hearing heard how Mr Beresford’s partner Tina Coupland, with whom he had a daughter Isobella, now four, said he called NHS Direct’s helpline on July 31, 2010 because he was feeling unwell.
However, despite experts telling the hearing that the symptoms that Mr Beresford gave were heart related and warranted a 999 call, an NHS Direct advisor did not log his symptoms as chest pain.
That error filtered into the assessments of three other health professionals, causing a misdiagnosis, including from nurse advisor Beatrice Makonyola who said Mr Beresford, of Gainsborough, had a chest infection.
The lorry driver was referred to Dr Richard Smith, an out-of-hours GP based at Lincoln County Hospital, who then booked an immediate appointment with Dr Lee, who was also working at John Coupland Hospital in Gainsborough.
Mr Beresford collapsed in a toilet cubicle 11 days later and died at Lincoln County Hospital on August 11, 2010.
Tricia Hamilton, NHS Direct’s clinical director, admitted it was a very serious failure.
Recording a narrative verdict, the coroner said “I am satisfied NHS Direct have taken this matter very seriously.
“There is a clear recognition by NHS Direct and Lincolnshire Health Trust that there have been serious failings on both of their parts.”

I look forward to seeing if the "3 strikes and your out". policy applies", being as I noted in my DPA that Mr Niall Dickson stated regarding myself.. "where were we with this one, 3 strikes and your out"?
But perhaps he was only referring to those people who complain about doctors involved in killing their loved ones that they do nothing about. Perhaps it is his only means of closing them down, when they can no longer give you the answers you want as they are frightened of the truth being exposed.

Of course the 'three strikes and you're out' routine can only apply to patients and their families if they agree.

I have found - as have many others - that the 'limpet gene', comes into play at that point, and with very good reason.

With that, I have followed (not as a stalker, I must add, but as a user of the freely given information internet) the joyful career of the decorated Jayne Brown, from Doncaster East PCT, to North and East Yorks and North Lincs Strategic Health Authority, to the interim SHA set up as that authority combined with others under Kathryn Riddle. That Interim group then made the decision about who would head the - also newly joined up - Doncaster PCT (made from 3 in the area.)

Curiously enough, having sat on that Interim Board, the bemedalled Jayne Brown then reappeared (lotsmoredosh) at Doncaster PCT. Then she moved on to the PCT at York.

Hope I haven't missed anything out, in the exalted career of Mz Brown.

I am sure that on the 'snouts in trough principle, she will rise highter yet.

But we must never forget that all sties are emptied at some time. I will look forward to that.

We are just learning about the abuse at St. Catherine's hospital, 4 workers are to be charged, but what about the people higher up, who must have covered up this abuse for several years, since complaints were started years ago.

Gillian Harding was working at St. Catherines and came out as a second opinion when my father was killed, she stated he definitely had oeosphageal cancer, yet the Pathology report proves he did not. She was suspended later, for some other misdemenour but is now working in Denaby.

Surely the people who are paid to make sure everything runs well, should have been charged.

Charlotte,

Firstly, I am sorry for your loss. Secondly, you have a right to access your father's medical records via his GP. That is sufficient for your to initiate a suit of negligence against the doctors in questions. Sue them to court and ignore the GMC. Once you succeed in court against them and you will provided that your records support that your father did not have these conditions, then you go after the GMC for their complicity once they became aware of the negligence of its regulated doctors and by which very act they continued to put the general public at risk of harm from these killers, and the further trauma they caused you by the rigmarole of their refusal to provide you with the perfectly reasonable request you made particularly under the Data Protection Act 1998. I read with interest your circumstances and I am very sorry for your loss. I have been involved with the NHS and the GMC for many years and understand your frustration. I agree with the last post advising you to persue a claim for medical negligence through a 'no win no fee' solicitor. Please do not be disheartened if the first solicitor rejects you, go to another until you get there!
Unfortunately, all of the various NHS complaints departments and the GMC are the SAME organisation. The GMC was set up to protect doctors, not patients. I am more than happy to correspond with you privately should you wish me to help in any way. Good luck! :)

Why do innocent people who cannot get answers forced to go to court when they cannot afford it and your life becomes consumed by the seeking of justice that should be given not battled for.
I am ashamed of what this country has become and the people in power who subjugate others daily at their whim all the acts they have no teeth and pretend they protect us and our rights, if you have the money to buy the Justice you are entitled to ....enforcement is whats needed and outlaw self policing an insult to us all and our families

If a person is deceased, access to their health records would come under the Access to Health Records Act, and not under Data Protection Act - though all other personal records would come under DPA.
Of course, where a wife or husband has killed someone, using the NHS, that person is legally counted as 'next of kin' even where the deceased has several blood children from a former marriage.
As next of kin, that person can refuse access to all records to the lawful children.. even where they all work together in agreement. That iniquitous position, is the reason why it is so difficult, though not impossible, to gain records which prove what happened.
And killers, together with the legal people in the NHS and other supposed safeguarding organisations (police, IPCC, Healthcare Commission, PHSO, etc) are laughing all the way to the bank.. as the vulnerable are quietly got rid of.

Please bear in mind the influences of Freemasonry in relation to the failures to investigate etc here. Many doctors are Freemasons and they can collude to cover up their crimes.

Freemasonry played a part in the failures to investigate Harold Shipman but you won't see it exposed anywhere.
