Who pays to repair roadside grass verge

We're waiting for Dave Cross to read a recent response and update the status.

Dear Wirral Metropolitan Borough Council,

Please inform me as to why, the house owner who has just built the house on the corner of Mill Lane & the A41 in Spital or the builder of said house Mark Taylor construction has not been charged to repair the damage to grass verge in the area. We as tax payers pay for the upkeep of the grass verge which are now destroyed and very unsightly

Thank you for your recent request for information.  Wirral Council
acknowledges your request for information and apologises for the delay in
response to your enquiry.

 

We can confirm your request is currently being processed by officers in
the Highways section.  However we have been unable to respond to you
within the timescale to provide to you a full and accurate response of any
information we can provide and we apologise for this delay.  We have sent

with under the Environmental Information Regulations 2004.  We trust this
finds you well.

enquiry, please now find a response from Wirral Council’s Highways &
Associated Services:

Please accept my apologies for the delay in responding to your enquiry.

 

The contractor who was responsible for the damage to the grass verge
outside the property at the junction of Mill Road and New Chester Road
during building works has undertaken some reinstatement to the verge and
has agreed to carry out further works to complete the repairs.

The highway inspector for this area has met with the contractor and has
received confirmation that the outstanding work will be completed as soon
as possible.

I can confirm that the Highway Inspector will continue to monitor the
situation on site and if the work is not completed to the required
standard the Council will undertake the work and recover the costs from
the contractor.

Thank you for the reply - however nothing has changed the contractors still parking Large Vans / Transits / cars on the grass verge causing damage - the last count was 6 vehicles parked at this location - the small van now replaced on the grass verge by the said Large Vans or Transit Low Loader vans - overnight parking and most of the day

I refer to your enquiry of 9 June 2020 and previous correspondence
regarding the vehicle overriding and damage to the verge at the junction
of Mill Road and New Chester Road.

 

The builder has not complied with the Council’s requirements to reinstate
the verge so I can confirm that the Council will now undertake the
necessary works and recharge the builder/property owner.

Dear InfoMgr, FinDMT,

With regard to your reply - the contractor has had an 8 ton skip on [what was] the grass verge for some days now along with 5 or 6 large vehicles most nights - perhaps you should get the skip removed to prevent less cost to you - also the vans are a constant road blockage at the busy lights
