I can confirm that your request will be processed under the Freedom of Information (Scotland) Act 2002, Environmental Information Regulations (Scotland) 2004, or the INSPIRE (Scotland) Regulations 2009.

You will receive the information requested within 20 working days unless the Council does not hold the information, or there is a reason for it to be withheld. We will write to you in any event. This means we have until 24/08/2020 to respond to your request.

Your request has been processed and considered under the Freedom of
Information (Scotland) Act 2002 and it is not possible to provide you with
the information you have requested on this occasion.

 

Under the terms of the legislation, a request for information can be
refused where one or more exemptions listed in the legislation apply. In
this instance, the Council is claiming the following exemption(s) to the
information that you have requested:

 

Section 33(1)(b) - Commercial interests and the economy.

 

This exemption applies when its disclosure under the act would, or would
likely to prejudice substantially the commercial interests of any person
(including without prejudice to that generality, a Scottish public
authority). The Council considers that if this information was disclosed
to you it would harm Journeo PLC’s commercial interests by providing their
competitors with an unfair advantage when competing for Council contracts
and work. The information being sought would provide unpublished detail of
Journeo PLC’s tender submission and if placed in the public realm would
give third-party competitors an unfair insight into Journeo’s supply chain
and the method by which some bids are constructed. The bid submission was
constructed in response to the tender in order to deliver a system that
was best suited to Edinburgh and its residents whilst delivering on-going
value.

I am also required to consider the application of the public interest test
in section 2(1)(b). In doing so the Council appreciates the public
interest in ensuring that it receives value for money and is transparent
and accountable in how it spends public funds. However, if the Council
were to release this information into the public domain, it would cause
substantial harm to the commercial interests of the contract providers, as
it could provide external providers with an unfair advantage when
competing for Council contracts and work. The Council therefore finds that
the public interest in providing this information is outweighed by the
Council’s need to maintain confidentiality on providers’ supply chain and
methods in line with the need to provide best value for money and ensuring
fair, open and transparent competition.

Please note that this letter constitutes a formal refusal notice under
section 16 of the Freedom of Information (Scotland) Act 2002.
