By law, you should have responded promptly and by 21 September 2021 latest to my FOI request as to who holds the Street Traders Licence for the Busby Rd Food Trailer in the layby beside that classified road the A727 near the Sheddens Roundabout.

As you have failed to do so, I am now requesting an internal review.

Our records confirm the trailer was licensed between 18th March 2015 and 20th March 2020, I do not have information on when the trailer actually traded. They were allowed to trade because ERC issued a street traders licence for that location.

Dear Abrami, Joe,

You say that you issued a Street Traders Licence for the trailer at Busby, which is parked in a layby beside a classified road. However, yourself and Brian Kilpatrick prepared a report stating that as I had traded beside a classified road, which you and Brian Kilpatrick stated was illegal, you proposed that I lose my Street Traders Licence.
This was backed up by Gerry Mahon, Senior Solicitor for East Renfrewshire Council, who wrote to say that under no circumstances was a catering trailer allowed to be sited in, or trade from, any layby beside a classified road.
So on what basis did you and Brian Kilpatrick issue a Street Traders Licence to the trailer in the layby, beside the main classified road in Busby?

Licences are issued by East Renfrewshire Council not individual officers. In this case the applicant applied for a fixed site in this location and the council separately granted planning permission for the site. The basis of the decision to grant is not recorded in licensing records.
