Whistleblowing
Dear Department of Health,
Following the publication of the inquiry into Stafford Hospital failings there is concern about the difficulties faced by whistleblowers in the NHS.
The majority of General Practitioners in the NHS work as contractors under GMS, PMS or APMS contracts; as such they are not employees.
For them to be protected from victimisation for whistleblowing they need to be recognised as 'Workers' for the purposes of the Employment Rights Act and the Public Interest Disclosure Act.
Does the Department of Health and its Regional Organisations (SHAs, PCTs )recognise GPs who hold GMS, PMS or APMS contracts as 'Workers'?
How will the Department of Health promote a culture of Candour in the NHS without guaranteeing protection from victimisation for whistleblowing GPs?
