What was the last date on which Legal aid was awarded for breech of human rights case where claimant had more that £8000 in capital?

The request was refused by Legal Aid Agency.

Dear Legal Aid Agency,

I made an application for legal aid to make a complaint against the United Kingdom for breeching my ECHR rights by enforcing a contract signed under fraud and duress. My case reference is 18-19-16804.

My request for exceptional legal aid was refused on the grounds I had more than £8000 in equity in my home.

What was the last date on which Legal aid was awarded for breech of human rights case where claimant had more that £8000 in capital, including equity in his home? What factors caused the Legal Aid Agency to decide to grant legal aid in that case, but refuse it in mine?

Yours faithfully,

keith gell

Dear Legal Aid Agency,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Legal Aid Agency's handling of my FOI request 'What was the last date on which Legal aid was awarded for breech of human rights case where claimant had more that £8000 in capital?'.

The Legal Aid Agency is obliged to provide funding for applicants whose rights have been breeched under the European Convention of Human Rights. One of the articles of this convention is the right to a fair trial. There is case law that this right can be breeched if there is no equality of arms, which may happen without legal aid. Therefore the Legal Aid Agency has a duty to keep a record of whether or not it has given legal aid to any application who has equity in their home of more than £8,000.

I therefore request an internal review of your response.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/w...

Yours faithfully,

keith gell
