Governance

Dear Mr Cowell,

I am writing in response to your email of 10 November which we are
treating as an internal review in respect of the response provided to your
Freedom of Information request of 12 October 2015. Our initial response of
15 October is attached.

You have queried the response provided as follows:

Why have you not replied to my FOI request, You do realise that it is a
legal requirement to do so

I can both confirm that the council has responded to your request and that
the response provided was an appropriate one. As was explained in our
initial response, where an individual seeks access to information under
the Freedom of Information Act which would relate to them personally, the
council is unable to confirm or deny whether it holds information as
providing such confirmation publicly would breach the Data Protection Act.
This is in accordance with provisions contained at section 40 (5) of the
Act. I am, therefore, satisfied that no further steps are required from
the council in respect of your request.

This concludes the council’s review of your Freedom of Information
request. If you remain dissatisfied with the council’s response to your
request you may wish to contact the ICO as previously advised.

Yours sincerely
