Your information request (FDN-255574)

I am writing in response to your email of 22 April 2016, in which you
advised that you had seen that new staff were given training under the
title of ‘What do we mean by maladministration?’  You then asked for
recorded information ‘regarding the PHSO meaning of maladministration’.

 

Please find attached the presentation slides used at the training you
referred to.  This is the only recorded information relating to that
training that we hold.  I have removed the names of the staff leading the
training as this is third party personal data which is exempt in line with
section 40(2) of the Freedom of Information Act 2000.

 

However, as you will see set out in the training slides, there is no
definitive interpretation of maladministration or a ‘PHSO meaning of
maladministration’.  This is because the term was left undefined in the
legislation which governs the Ombudsman’s work: the Health Service
Commissioners Act 1993 and the Parliamentary Commissioner Act 1967.

"Not upheld complaints

"• We have seen no evidence of maladministration or
service failure.

"• We have seen evidence of maladministration and or
service failure but are satisfied that the body has
already taken action to put that right."

After years of messing a complainant around, the body complained about that finally takes action to put matters right (in the opinion of the Ombudsman) is off the hook!
