Westminster CCTV Smart Car KV58 YSD

Response to this request is long overdue. By law, under all circumstances, Westminster City Council should have responded by now (details). You can complain by requesting an internal review.

Dear Sir or Madam,

Could you advise on whether the vehicle specified above has a 'Run-Lock' system allowing the driver to legally vacate the vehicle and leave the engine running?

Example video http://nutsville.com/?p=981

Could you advise on any of the Westminster fleet, either owned by Westminster or contractors working for the council, have 'Run-Lock' systems allowing the drivers to legally vacate the car while the engine is running?

Other than street cleansing vehicles, does Westminster use any vehicles that can be legally vacated whilst the engine can be left running, if there are can you identify them please?

Yours faithfully,

Mr Sawyer

Dear Customer Relations,

Thanks for your response. From it, can I take it that Westminster has no interest in how legal (or otherwise) it's contractors are when providing services to it's residents and visitors?

Can you please approach NSL Services Ltd and ask if they have any such vehicles which allow legally leaving them with the engine running. Could you also ask them if the above stated vehicle has such a system.

Were there any contractual agreements with NSL Services Ltd with regard to breaking the Law and what would the repercussions be if NSL Services Ltd were to break the law?

Lastly:

"Could you advise on any of the Westminster fleet, either owned by Westminster or contractors working for the council, have 'Run-Lock' systems allowing the drivers to legally vacate the car while the engine is running?

Other than street cleansing vehicles, does Westminster use any vehicles that can be legally vacated whilst the engine can be left running, if there are can you identify them please?"

Has not been answered, could you please supply an answer those questions?

Yours sincerely,

Mr Sawyer

Gordon Deas must be some sort of time lord "Thank you for your follow up e-mail dated 1 September 2008 in relation to FOI request 4278". 2008?

Dear Customer Relations,

Thank you for your response. Could I ask (as WCC are concerned about employees and contractors working standards and conditions) what the process is for following up a blatant disregard for law (as in this case) with contractors?

Can I ask where (and could I have a copy) in any contractual agreement where these procedures are outlined?

Yours sincerely,

Mr Sawyer

Dear Tanya,

Thanks for your response. On the 2nd of October 2009 I asked:

"Thank you for your response. Could I ask (as WCC are concerned
about employees and contractors working standards and conditions)
what the process is for following up a blatant disregard for law
(as in this case) with contractors?

Can I ask where (and could I have a copy) in any contractual
agreement where these procedures are outlined?"

I'm sorry that wasn't clear enough for you and I had to ask the ICO for help. Just a suggestion but wouldn't it help to be more open within the spirit of the Act rather than obstructive?

I'll see if I can find and email address for you and send a delivery address or I can collect in person if that's better.

Yours sincerely,

Mr Sawyer

FOI, Westminster City Council

Dear Mr Sawyer,

Thank you for your email below.

If are able to collect the information I will arrange to have it on
reception for you at City Hall, and will confirm when it is available.
You will, however, need to provide a proof of identity on collection.

Alternatively you can contact us to provide a delivery address. To that
end I am providing the following link to the Westminster City Council
website which provides our email address. Please note that the telephone
number for the FOI Team on the site is, however, incorrect and we are in
the process of getting this changed.
