Thank you for your request for information about the demolition contractor
for the Westcliffe Hospital site.  Your request was received by the
Information Rights Team on 31 March 2012.  This is being dealt with under
the terms of the appropriate Information Rights legislation.

Your request for information on Westcliffe Hospital

 

Although we do hold all the information that you have asked for,
unfortunately some of it is exempt under section 12(5)(e) of the
Environmental Information Regulations 2004 and will not be provided. A
copy of the information which can be provided is attached.

 

Regulation 12(5)(e) allows us to withhold information if it would
adversely affect the confidentiality of commercial information and the
protection of the legitimate economic interest. This exception applies
because it could adversely affect the commercial interests of the company
concerned if a breakdown of the costs for its services are made public as
it would affect their ability to participate competitively in a commercial
activity.

 

It is considered that the public interest in withholding the information
is stronger than the public interest in disclosing it.  This is because
disclosure of this information would result in commercial organisations
being less inclined to tender with the City Council, which would counter
the Council's primary objective to obtain best value for the goods and
services it purchases on behalf of the public.

 

The information supplied may be used for domestic or journalistic
purposes. Its use for commercial gain including issuing to the public may
be subject to the issue of a licence under the Reuse of Public Sector
Information Regulations 2005.
