Dear West Midlands Police,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of West Midlands Police's handling of my FOI request 'West Mids: Complete Marked Fleet List'.

Your response is late. You have breached s.10(1)...

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/w...

I've got a funny feeling that WM Police don't want to disclose this information to me... I wonder why... Could they be hiding the fact that a certain police vehicle does infact have CCTV / Video Recording in car, and thus they'll have to provide said evidence to my solicitor which will mean they've destroyed their defence and may be required to bring formal assault charges against their "officer"...

Wayne,I know how WM Police operate, they dismiss questions on the grounds of `too many`or `vexatious`.Keep things simple because your batch of requests are providing them wih excuses, and just doggedly persue the key questions to try to get a result.

Thanks Dennis. I'm aware of the exemptions of the act. I'm certain they can't refuse any of my requests due to the obviously genuine reasons for request.

Dear Mr Pearsall

FOI Request Reference: 003369/15

Thank you for your request (ref 2783/15) for information received

we failed to issue a response within the 20 working day deadline,
therefore please see the following response in respect of your request for
an Internal Review.

Internal Review Request

I am writing to request an internal review of West Midlands Police's
handling of my FOI request 'West Mids:  Complete Marked Fleet List'

Request

Could you provide me with a complete Fleet List for all of your marked
police vehicles;

Please could you also state for each vehicle;

- Vehicle Make & Model

- Role (IE: SNT, Beat, Patrol, CCTV, ETC.)

- Station it's based at

- Registration Plate

- Internal Fleet Number / Designation

- Whether a camera system is fitted (if so, what type, CCTV, ProVida ETC)

Response

Please find attached our response.

In relation to the make of cameras within the car our fleet services
department advise that most are Provida systems, however they do not
record individual camera details.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
decision. The Information Commissioner can be contacted at: Information
Commissioner’s Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9

ICO Communication:

"FS50597239
You made a request for a detailed break-down of the Constabulary fleet list on 22 July 2015. The Constabulary responded to the request on 21 September 2015. It provided you with the information you asked for, with the exception of the make of camera information, which it said it does not hold.

Section 10 of the FOIA states that a public authority must comply with a request promptly and not later than the twentieth working day following the date the request was received.

You submitted your request on 22 July 2015, and so the Constabulary should have responded by 19 August 2015 at the latest. By responding on 21 September 2015 it exceeded the 20 working days set out in the FOIA and breached section 10(1). "
