request whereas it should have been logged as an Environmental Information

Further to your request for information relating to WEEE Tenders I have
liaised with the Council's Waste Management Procurement and Projects
Manager who has provided the following in answer to your request:

1) Date of the next tender for the "Collection and Disposal of WEEE (Waste
Electrical and Electronic Equipment) and Batteries for the council.

The current WEEE and Batteries contract arrangements run for a period of 2
years with an option for a further 1 year extension.

This contract commenced on 1 January 2011. It is therefore possible that a
new procurement process could be commenced June/July 2012 but subject to
satisfactory performance this may be extended to June/July 2013

2) Also a copy of the previous successful tender for the collection and
disposal of WEEE.

The substance of the existing scheme operators pre-contract
submission is considered to be commercially confidential and the release
of this information would be likely to prejudice the commercial interests
of the Contractor and Authority. In considering whether the release of
this information would, or would be likely to harm someone's commercial
interests this is readily evidenced insofar as the Contractor operates in
a commercial environment, their commercial activity is regularly
undertaken in competition with other WEEE scheme operators. The
operational and viable plans (parts of which were submitted) are the
business plans of the Contractor and the combination of their
skills/commercial offering of information allows them to compete with this
as a differentiator.

In arriving at our decision about disclosure the Authority must consider
whether there is an overriding public interest in providing the requested
information. The Authority has taken account of all of the
factors referred to above and considers that the prejudice likely to be
caused to the winning tenderer will weaken its position in a competitive
environment by revealing market sensitive information and information of
potential usefulness to its competitors. This therefore outweighs any
benefit from disclosure to the wider public and the Authority takes the
view that the information cannot be released by virtue of Regulation
12(5)(e) of the Environmental Information Regulations 2004, and in as much
as this information might fall under the scope of the Freedom of
Information Act 2000, the Section 43(2) exemption applies.
