Website accessibility disproportionate burden

I am contacting you with regard to your website accessibility statement:

In the statement you claim disproportionate burden under Part 2 Section 7 of the Public Sector Bodies (Websites and Mobile Applications) (No.2) Accessibility Regulations 2018: https://www.legislation.gov.uk/uksi/2018....
As required by Part 2 Section 7 (2) of the regulations mentioned above, you were required to conduct an assessment of impacting factors before making the disproportionate burden claim. Information on the types of evidence expected in the assessment can be found in the latest monitoring report produced by GDS: https://www.gov.uk/government/publicatio....
I have noticed that your disproportionate burden claim happens to match word for word that which is provided in the example accessibility statement by the monitoring body: https://www.gov.uk/government/publicatio.... In particular the following:
It’s not possible for users to change text size without some of the content overlapping.
Given that you made a claim in the accessibility statement (undated), please can you provide me with all documentary evidence that meets monitoring expectations which supports your disproportionate burden claim and shows that you have not just copy/pasted the example into a legal claim without completing your legal due diligence.

The reason for the disproportionate burden claim is included within the
statement itself -
“It is not possible for users to change text size without some of the
content
overlapping. This fails WCAG 2.1 success criterion 1.4.4 (resize text).
However,
the zoom function present in most modern browsers does not cause
overlaps.”
“We’ve assessed the cost of fixing the issues with navigation and
accessing information.
We believe that doing so now would be a disproportionate burden within the
meaning of
the accessibility regulations. We will continue to monitor this and make
changes where
Necessary.”
This guidance was offered to us by JISC, the above statement summarises
where we believe our current website does not meet accessibility
guidelines. We advise visitors that if they need information on the
website in a different format such as accessible PDF, large print, easy
read, audio recording or braille they can contact [1][BCA request email]
or call 01628 824444.
In terms of further development on the existing header menu, further
cost/benefit assessment was deemed as not required as we have a new
website launching before the end of this year. The new developers will
perform an accessibility audit of the new site and are following web
accessibility advice and guidance.
