Dear Wirral Metropolitan Borough Council,

Mike Folwer worked for Wirral Borough Council department of Social Services from 21.7.2003 until the day before the AKA report was released. He was suspended for a period of months and subject to the disciplinary process.

During this time the Department discriminated against disabled adults, implemented a possibly illegal delay in care, misappropriated funds from other departments, hid key facts from elected members, failed to manage providers, failed to safeguard vulnerable adults with inconsistent
and variable practice, failed with any quality assurance, failed to follow whistleblowing claims, bullied and harrassed employees,failed to recoup £4,000,000 in fairer charging revenue, explicitly disclosed that there was a strategy of destabilisation to care providers. It was also red flagged by the audit commission,suffered a damning CQC report which detailed how the ability to improve was uncertain.

Please disclose the exit interview between WBC and Mike Fowler.

Good Afternoon,

Thank you for your request for information shown below.  On this occasion
the Council is unable to provide the information which you have
requested.  In deciding to refuse to disclose the requested information,
the Council has relied on the exemption contained in Section 40 (2) of the
Freedom of Information Act.

The Exit Interview contains Personal Data and the Council does not
consider that as the requester, you could satisfy the sixth condition in
Schedule 2 of the Data Protection Act 1998, which states:-


The processing is necessary for the purposes of legitimate interests
pursued by the data controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject.


The Council considers that the disclosure of the information sought would
be unwarranted by reason of prejudice to the rights and freedoms or
legitimate interests of the Data Subject, Mike Fowler.


You have the right under Section 17 of the Freedom of Information Act 2000
to ask for an internal review of the refusal to some of the information
requested.  Please would you direct any request for an internal review to

You do also have the right to complain to the information Commissioner, if
