Good Morning,

This email is in response to your request for an internal review and I
apologise for the time it has taken to respond to you.

The findings of the Internal review are that:-

 

The Council is unable to provide the information you have requested as we
believe to provide the information would potentially identify a living
individual and this would breach the requirements of The Data Protection
Act 1998.  This identification would leave the Council open to a claim
that we have inappropriately disclosed Personal Data.  Because of this,
we consider that the information requested is exempt from disclosure under
Section 40(2) of The Freedom of Information Act. 

 

We further believe that we can also reply on the exemption contained in
section 41 of the legislation in that the information was provided in
confidence and disclosure of the information would be a breach of that
confidentiality.

Thank you for your response. I acknowledge your reliance on section 41 of the Freedom of Information Act 2000, however the reliance on section 40(2) relies on personal data as per the conditions of Schedule 2 of the data protection act 1998 of which would not apply in this case.
