Borough Council's handling of my FOI request 'WBC - Cost of
Fighting paying benefits to vulnerable adults'.

Good Afternoon,

Thank you for your enquiry below.  Please see our reply also below which I
trust you find of use.  The response is based on the recorded information
held by Weightmans Solicitors who acted on the Council’s behalf and also
information held by the Council.

 

In relation to the entirety of the costs, it is simply not possible to
'unpick' those costs that related solely to the "person affected" issue.
Particularly before the First-tier Tribunal as there have been a multitude
of legal issues that had to be dealt with.

 

In relation to the Court of Appeal I can confirm that the total costs
billed by Weightmans from 16 February 2011 (being the date we had a
conference to decide on whether to appeal the decision of the Upper
Tribunal) to 15 February 2012 - being the last bill, to include all costs,
all disbursements (e.g. counsels' fees, court fees, travel etc) and VAT
was £29737.80

 

I would add that in terms of counsel, the other side had both Queen's
Counsel and junior counsel and Weightmans felt it was appropriate for the
Council to be similarly represented and that a costs order was made
against SIL. They are therefore obliged to pay the Council's costs. The
precise amount will either be agreed between us or will be determined by
the Court.  A schedule of Weightmans costs sought from SIL is to be
shortly sent to their solicitors.

 

The authorising officer for the Council is Ian Coleman - Director of
Finance & Deputy Chief Executive.
