Dear South Staffordshire Water Plc,

I would like to request the daily water fluoride concentration (Fluoride mg/L) plant monitoring records for the treatment works where you carry out water fluoridation.

I would also like the same information (daily fluoride concentration) for any treatment works where the water is naturally fluoridated (>0.4 mg/L).

I would like the records for as far back as you have them, in an excel format please.

Thank you for your email request dated 12 March 2018 for information under the Environmental Information Regulations 2004 (EIR).

You requested the following information:

I would like to request the plant monitoring records for the treatment works where you carry out water fluoridation.
If you have any treatment works where the water is naturally fluoridated, I would also like to request the dose monitoring records for those.
I would like the records as far back as you have them, for every day if possible, in an excel format please.


South Staffordshire Water’s Compliance Team has reviewed your request and the information concerned. South Staffordshire Water’s position is that it is not required to disclose the information requested under the EIR. The EIR contains various exemptions to the duties of disclosure and we consider that two of these exemptions apply to this request:

Regulation 12 (4) (b) – Manifestly Unreasonable

Under this exemption, an authority can refuse to disclose information if the cost of complying with the request is too great. South Staffordshire Water’s Compliance Team have reviewed the request and the information held for the 23 sites that dose fluoride. You have requested the information for every day and for as far back as held. Our monitoring data is recorded continuously and is collated based on 4 minute averages. Across all sites, this would equate to nearly 3 million points of data each year. The work involved to collate this data would take many weeks of staff time, resulting in the costs of complying with the request being excessive and therefore the request is manifestly unreasonable. We have balanced the application of the exemption against the public interest in disclosing the information and are satisfied that the exemption should apply. In particular, information about fluoridation is publicly available from Public Health England.

Regulation 12 (5) (a) – International relations, defence, national security or public safety

Under this exemption, an authority can refuse to disclose information if disclosure would adversely affect international relations, defence, national security or public safety. Some of our treatment works are Critical National Infrastructure (CNI) sites. Guidance recently issued by the Centre for the Protection of the National Infrastructure has highlighted a risk of sabotage capability at those sites, including information on chemicals. On this basis, we believe disclosure of information relating to storage on CNI sites would adversely affect national security and public safety. In coming to this conclusion, we have balanced the application of the exemption against the public interest in disclosing the information and are satisfied that the exemption should apply.
