The request was refused by Severn Trent Plc.

Dear Severn Trent Plc,

I would like to request the plant monitoring records for the treatment works where you carry out water fluoridation.

If you have any treatment works where the water is naturally fluoridated, I would also like to request the dose monitoring records for those.

I would like the records for as far back as you have them, for every day if possible, in an excel format please.

Yours faithfully,

Deborah

Good morning Deborah

Thank you for your request made on 12 March 2018 for information under the
Environmental Information Regulations 2010 (EIR).

You requested the following information:

I would like to request the plant monitoring records for the treatment
works where you carry out water fluoridation.

If you have any treatment works where the water is naturally fluoridated,
I would also like to request the dose monitoring records for those.

I would like the records for as far back as you have them, for every day
if possible, in an excel format please.

Having reviewed your request and the information concerned, Severn Trent’s
position is that it is not required to disclose the information requested
under the EIR. The EIR contains various exemptions to the duties of
disclosure and we consider that two of these exemptions apply to this
request:

Reg 12(5)(a) – International relations, defence, national security or
public safety

Under this exemption, an authority can refuse to disclose information if
disclosure would adversely affect international relations, defence,
national security or public safety. Many of our water treatment works are
also Critical National Infrastructure (CNI) sites. Guidance recently
issued by the Centre for the Protection of National Infrastructure in
light of the current situations between the UK and Russia has highlighted
a risk of sabotage capability affecting CNI sites, including information
on chemicals. On this basis, we believe disclosure of information relating
to chemical storage at CNI sites would adversely affect national security
and public safety. In coming to this conclusion, we have balanced the
application of the exemption against the public interest in disclosing the
information and are satisfied that the exemption should apply.

Reg 12(4)(b) – Manifestly unreasonable

Under this exemption, an authority can refuse to disclose information if
the cost of complying with the request is too great. We have reviewed the
request and the information held for sites that dose fluoride, of which
there are 33. You have requested the information for every day and for as
far back as held. Our monitoring data is recorded continuously and is
collated based on 15 minute average. Across all of the sites where
fluoride is dosed, this would equate to 17 million points of data per
year. The work involved to collate this data would take many days (or even
weeks) of staff time, meaning the costs of complying with the request are
excessive and therefore the request is manifestly unreasonable. We have
again balanced the application of the exemption against the public
interest in disclosing the information and are again satisfied that the
exemption should apply. In particular, information about fluoridation is
publicly available from Public Health England.

If you are unhappy with our response to your request, you can ask for an
internal review of the response. Please respond to this email address
marking your email for the attention of the legal team.

If you remain unhappy after the internal review, you can complain to the
Information Commissioner’s office at Wycliffe House, Water Lane, Wilmslow,
Cheshire SK9 5AF. Further details are available at ico.org.uk.

Kind regards

Mrs Susan Thomas
