Dear Tonbridge and Malling Borough Council,

For the current contract(s) tendered/won and now in place for waste management, litter picking and the like in the borough, please respond to the following with supporting documentation:-

1. The appointed contractor/contractors
2. The scope of their services to TMBC.
3. The specification to which the services must be provided including a list of legal requirements, acts of Parliament, codes of practice, QA standards & benchmarks and council specific requirements.
4. Was ISO 9000 accreditation a pre-requisite at tender stage?
5. Do the contractors or contractor have an accredited QMS system?
6. Please provide full details of the QA/QC requirements for this contract - inspection and testing regime for all works including works sign off process/evidencing and by whom and the control of non- conforming works procedures.
7. Please confirm when the current contract(s) started and when it / they will end.
8. Please confirm how many NCRs (or non compliance notices or similar) have been issued to the contractor(s).
9. Does the contract provide for any financial penalties for non delivery / poor performance?
10. If yes please confirm examples of what would be a penalty.
11. How many financial penalties have been issued?
12. Please provide a copy of the council’s management org chart to manage / oversee the contract(s) including names / positions/ duties / pay grades.
13. Please provide a copy of the contractor (s) org chart for delivering the contract(s) - no names necessary so if no org chart provided or available from please just list the minimum management roles /positions and staffing / resources expected by the council under the contract(s).
14. Please confirm the value of the current contract(s).

Thank you for your e-mail, requesting that certain information is made available to you under the Freedom of Information Act 2000/Environmental Information Regulations 2004. The Council has now started to process your request.

The Council always aims to disclose information as quickly as possible. Once the information has been identified, the Council can also ask that you pay a fee to cover the costs of any printing, photocopying, postage, etc., for processing and delivering the information to you. Details of any fee to be paid will be notified to you as soon as possible.

Generally, the ICO cannot make a decision unless you have exhausted the internal review procedure provided by the Borough Council.
