Dear Bradford City Council,

With reference to the Telegraph and Argus report concerning fly tipping blighting Bradford Streets.

Would you be so kind and to supply the following information.

1, from the original reporting( The complainant) of waste being tipped to disposal( Job done ((without offender)), what is the cost to the council of cleaning the site of a tip(minimal expense to maximum expense), ie what is the least the council has spent? on any one clean up operation, and the maximum, the council has spent? on any one clean up operation..

2, what is the cost of taking a known offender to court(before a fine is levied), how much does the council pay for this process?, before recovery.

3, what is the maximum fine that a fly tipping offender can be fined.

4, does the court accept any early guilty plea and 4A, does the court give a credit for an early guilty plea to the offender.

5, can you supply the figures for offenders caught fly tipping( Along with their Fine and costs) for the last 13 years.

6, Can you supply the number of fly tipping clean ups for the last 13 years

I refer to your request dated 3^rd January 2021 under the Freedom of
Information Act asking to supply the following information:

With reference to the Telegraph and Argus report concerning fly tipping
blighting Bradford Streets.

Would you be so kind and to supply the following information.

1 - from the original reporting(The complainant) of waste being tipped to
disposal(Job done ((without offender)), what is the cost to the council of
cleaning the site of a tip (minimal expense to maximum expense), ie what
is the least the council has spent? on any one clean-up operation, and the
maximum, the council has spent? on any one clean-up operation.

Response – It is not possible to provide this information as the Council
does not itemise fly tipping costs as it would generate more
administrative work and increase costs that would provide no added benefit
to the Council.  The majority of fly tips are collected through the normal
working day by our clean teams who will collect tips as and when requested
as part of their daily tasks.

2 - what is the cost of taking a known offender to court(before a fine is
levied), how much does the council pay for this process?, before recovery.

Response - There is no court fee, but there is the cost of officer time in
investigating the matter, and of dealing with the court process.  Those
costs depend on the particular circumstances of each case.

3 - what is the maximum fine that a fly tipping offender can be fined.

Response - The maximum Fixed Penalty Notice for fly tipping is £400. 
After prosecution there is no maximum fine as it is unlimited, or the
offender can face up to five years in prison.

4 - does the court accept any early guilty plea and 4A, does the court
give a credit for an early guilty plea to the offender.

Response - Whether the court accepts a guilty plea is a matter for the
court but generally a guilty plea will be accepted provided the person is
able to enter their plea i.e. they have no mental incapacity issues and
are able to understand the charge put to them. Courts take an early guilty
plea into account when deciding on a sentence.

5 - can you supply the figures for offenders caught fly tipping (Along
with their Fine and costs) for the last 13 years.

Response - Please see attached spreadsheet. This includes prosecutions and
cautions for fly tipping, and also Fixed Penalty Notices and Householder’s
Duty of Care FPNs. Please note the Council does not hold records dating
back 13 years but we have provided what we currently hold.

6 - can you supply the number of fly tipping clean ups for the last 13
years

Response - Please see attached spreadsheet. This is by quarter with a
total for the annual number of clear ups. Please note the Council does not
hold records dating back 13 years but we have provided what we currently
hold.

 

In accordance with the Freedom of Information Act, if you are not
