Dear Mr Robson

I am sorry that we have not yet responded to the above referenced FOI request.

I have asked the department concerned if they are in a position to do so now.

Independently of this manager who is senior to the person dealing with the request and has not been involved in it will conduct an Internal Review into the delay. They will aim to respond within 20 working days of the date of your complaint, although the timescale can be extended to 40 working days if the issues are complicated.

Dear Mr Robson,

 

Brent’s disposal costs in 2011/12 are set out below. The total cost is
£9.779m. The fixed levy element is apportioned to all 6 boroughs that
comprise the West London Waste Authority on a population basis. The total
cost to all boroughs is £7.7m (the breakdown is et out in the last
table). Brent’s allocation is £1.294m

Dear Mr Robson

I am writing to respond to the request for Internal Review you made on 10th September. I understand the substantive response was sent to you today under separate cover.

The Internal Review would normally be dealt with by a senior manager from the service concerned but this is not practical in this instance.

Your complaint is upheld. Your original request was submitted on 19th July 2011 and a response should have been sent to you by 16th August. The Council breached section 10 of the Act by failing to respond within the deadline. Please accept our apologies for this oversight. This was due to an administrative error that meant that the request was not referred to the service unit concerned. This may have been associated with a service re-structure which has since been completed along with new structures for dealing with FOI requests.

Please also accept our apologies for not having included notice of your rights of appeal with the response. These are set out below.
