Waste and recycling dates

The request was partially successful.

Dear Aberdeen City Council,

Please provide the following data, under FOI:

1) Waste and recycling dates for all properties, organised by address and postcode. Under Section 11 FOIA, I request that all data is provided in CSV format. A link to a web service does not meet my requirements: I need the source data. Please include the UPRN for each property. This is now permitted by the AddressBase licence. See https://www.ordnancesurvey.co.uk/about/n... for details.

2) All information required to convert schedule codes to calendar dates, including week codes for fortnightly collection and changes for bank holidays etc.

3) Details of any planned changes to the schedules.

Foi Enquiries, Aberdeen City Council

Dear Mr Kane,

In relation to your request, please allow me to provide you with a quick
update.

I have been in contact with the relevant service to see how they were
getting on with processing your request. They have advised me that they
have currently been unable to extract the data that you have asked for. In
explanation, they advised me that the source data requested is held by a
third party and ACC is allowed access to the data to enable their
functions but the source data is not technically held by ACC in a way that
would allow us to provide it to you.

They have contacted the third party to see if there is any way that we can
be provided with the source data to allow us to respond to your request.
They have advised me that this is looking promising but may take 2 or 3
weeks to get.

Whilst we are still hopeful of responding to your request within the 20
working days (i.e. by 3 August 2017), I thought it be a good idea to let
you know the current situation in case there is a delay.

We are endeavouring to provide you with the information you requested as
soon as is possible.

Yours sincerely,

Grant Webster

Dear Mr Kane,

Thank you for your information request of 6 July 2017.  Aberdeen City
Council (ACC) has completed the necessary search for the information
requested.

Please provide the following data, under FOI:

1) Waste and recycling dates for all properties, organised by address and
postcode. Under Section 11 FOIA, I request that all data is provided in
CSV format.  A link to a web service does not meet my requirements: I need
the source data. Please include the UPRN for each property. This is now
permitted by the AddressBase licence. See
[1]https://www.ordnancesurvey.co.uk/about/n...
for details.

Please see attached.

Addresses and postcodes etc. can be found by inputting the UPRN into the
following site:

[2]http://www.onescotlandgazetteer.org.uk/

As Addresses and postcodes are otherwise accessible at the link provided
above, it is exempt from disclosure.  In order to comply with its
obligations under the terms of Regulation 13 of the EIRs, ACC hereby gives
notice that we are refusing your request under the terms of Regulation
6(1)(b)  - Information Already Publicly Available - of the EIRs.

2) All information required to convert schedule codes to calendar dates,
including week codes for fortnightly collection and changes for bank
holidays etc.

There are no conversion tables as the storage system only works on one
date.

ACC is unable to provide you with information on All information required
to convert schedule codes to calendar dates, including week codes for
fortnightly collection and changes for bank holidays etc as it is not held
by the Council.  In order to comply with its obligations under the terms
of Regulation 10(4)(a) - Information Not Held - of the EIRs, ACC hereby
gives notice that this information is not held by it.  ACC is required by
Regulation 10(1)(b) of the EIRs to inform you as to why in all the
circumstances of the case, the public interest in maintaining this
exception outweighs the public interest in disclosing this information to
you.  ACC is satisfied that it does not hold this information and
considers that, as there is no information held, the public interest lies
with the exception.

3) Details of any planned changes to the schedules.

None planned. However with large datasets there are constant changes as
new properties are added and errors corrected.

We hope this helps with your request.

Yours sincerely,

Grant Webster

Dear Aberdeen City Council,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Aberdeen City Council's handling of my FOI request 'Waste and recycling dates'.

I believe that regulation 6(1)(b) was incorrectly engaged. In order to match the UPRNs to addresses I would need to perform 146943 individual searches on the linked website, which is not "easily accessible" for the purposes of the regulation. The guidelines state that cost is also a factor in determining if the data is publicly available. If I were to purchase the data, it would cost me over £130,000 per year from the OS. Please provide sufficient address detail to allow me to match individual addresses to schedules. Property number, street and locality is sufficient.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/w...

Yours faithfully,

Matt Kane

2017.

Please do not hesitate to get in touch if you have any queries relating to
the review.

Yours sincerely

Dear Mr Kane,

I refer to your email requesting that Aberdeen City Council (ACC) review
its handling of your request.

Please find below our revised response.

Please provide the following data, under FOI:

1) Waste and recycling dates for all properties, organised by address and
postcode. Under Section 11 FOIA, I request that all data is provided in
CSV format.  A link to a web service does not meet my requirements: I need
the source data. Please include the UPRN for each property. This is now
permitted by the AddressBase licence. See
[1]https://www.ordnancesurvey.co.uk/about/n...
for details.

Please see attached.

Aberdeen City Council is unable to give permission for you to re-use
information for which it does not hold the copyright. I understand that
the Ordnance Survey and the Royal Mail have an interest in the addresses
provided in our response, and therefore we are unable to grant you
permission. We grant permission for the re-use of the data in relation to
the other information not specified above but please be aware, the data
provided may change if we review our waste services in future.

We hope this helps with your request.

Yours sincerely,

Grant Webster

On behalf of Review Panel Clerk
