Dear Ms Morera,

Re: Freedom of Information Act Request ref: LBH/8738119

Thank you for your request for information received on 20 May 2019, in
which you asked for the following:

Please supply details of any costs paid by Haringey Council on behalf of
Grainger or any related private companies in relation to the CPO and
associated public inquiry. ([1]http://seven-sisters.persona-pi.com/)

Please specify which of these costs will and will not be recoverable by
Haringey council.

Please indicate the policy or legal framework that allows for any payments
that are not recoverable by the council.

My response is as follows:

Grainger Seven Sisters Limited and Northumberland & Durham Property Trust
Limited entered into a Development Agreement with the London Borough of
Haringey on 3^rd August 2007. This Development Agreement set out the form
of development required at Wards Corner and regulated the relationship
between the parties including CPO indemnity provisions.

The Development Agreement was subsequently varied through a Supplemental
Agreement dated 23^rd January 2015 (This document is publicly available
online at -
[2]http://bailey.persona-pi.com/Public-Inqu...)
and a separate CPO Indemnity Agreement (CPOIA) was also entered into on
23^rd January 2015 (copy attached).

The CPOIA is an agreement between the Council, as Acquiring Authority and
Grainger, the private developer to fund the CPO process. The agreement
provides that the Acquiring Authority will exercise its compulsory
purchase powers if it is proper to do so and to ultimately transfer the
land in return for Grainger paying all costs incurred by the process as
well as compensation to affected parties. To date the Council has not
expended any monies in relation to the CPO which have not been recoverable
under the CPOIA.

If you are unhappy with how we have responded to your request you can ask
us to conduct an Internal Review. If so, please contact the [3]Feedback
and Information Team. (Please note you should do so within two months of
this response.)
