Response to this request is long overdue. By law, under all circumstances, Wandsworth Borough Council should have responded by now (details). The person who made the request can complain by requesting an internal review.

Dear Wandsworth Borough Council,

In your reply to the above request dated 28th April you noted that:

We can confirm that information is held, within the scope of your
application. It is important to note that the demands on the council’s
capital programme to invest in its own land and property unsurprisingly
exceeds the resources available and therefore each year schemes will
always undergo an element of prioritisation by officers in discussion with
the relevant portfolio holders, which is the usual part of the development
of the final recommendations seen by members on the Finance, Resources and
Climate Sustainability OSC. These papers have been considered under
Regulation 12(4)(e) (Internal Communication) of the EIR and deemed exempt
from disclosure. For reference, the data forms part of internal policy
formulation and constitutes the Council’s ‘thinking space’ before policies
are adopted. Disclosure of such information may also inhibit free and
frank discussions in the future, resulting in a ‘Chilling Effect’ which
could change how reports are written and also damage the quality of
advice, leading to poorer decision making going forward. We therefore
consider this exception to be engaged. We have next considered the public
interest in disclosure, or maintaining the exception. Whilst the Council
recognises the public interest in transparency, generally, as well as the
presumption in favour of disclosure required by Regulation 12(2), it has
weighed this against the negative impacts upon policy formation and
decision making, outlined above. Having undertaken this balancing
exercise, the public interest is considered to weigh in favour of
withholding the requested information.

Please explain the process for deciding what capital expenditure
projects were recommended to the Finance, Resources and Climate
Sustainability Overview and Scrutiny Committee: in what forum / committee
is this debated and decided and who are the councillors who sit on that
committee?

 

           No committee consideration other than the Finance OSC and then
Executive.  Proposals at their formative stages were discussed by
portfolio holders at meetings in January 2021.
